On February 8, 2011 we were notified that our AOS case had been transferred to the CSC. Yes, from what I understand we may possibly be processed for a GC without an interview. This morning I checked the USCIS WEB site around 7 am, and no change of status. However, I get home and inside our mailbox is a notice (I-797C) stating that on April 14, 2011, we have been transferred to the NBC. As I have seen others post, so far nothing unusual to have it reversed back to the NBC from the CSC. Hang on, because you we’ll love this one! (Smile) So, just out of sheer curiosity I wanted to see if it was likely posted on the USCIS WEB site this afternoon, and it was. However, this is what was posted:

“On April 14, 2011, we transferred this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our CALIFORNIA SERVICE CENTER location for processing and sent you a notice explaining this action.”

In summary, on the tangible paper (I-797C) that was issued on April 14, 2011, it is labeled “Transfer Notice” to the USCIS – NBC, yet to reiterate, displayed on the USCIS site for my case number it asserts on April 14, 2011, it was transferred to the CSC. Thus, we have no idea where are AOS application is as of now. Ok, anybody ever encountered this dilemma? All and any feedbacks will be very much appreciated, along with any advice! Thanking all of you in advance.

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

UPDATE: As I anticipated, due to the discrepancy of our AOS transfer, it was imperative that I call the USCIS hotline. Overall, I was met with a very cordial response while dealing with the USCIS during the phone call. On the other hand, I’m still baffled by the conversation! Entailed in my experience you are initially greeted by a “Phone Screener,’ then if your circumstance is validated, you are then transferred to another agent. Within the first stage of the conversation the representative confirmed that our case was in transit from the CSC to the NBC. Then out of curiosity I asked the agent a series of questions, and all focused around whether or not we would encounter an interview having been transferred to the NBC. Keep in mind it is a USCIS policy that the applicant and petitioner must be present, in the same room, during the conversation. In fact, my wife being the applicant had to give permission for me to inquire about our case. When submitting each question, I was very articulate, spoke clearly, and each question my words were very logically placed.

In all fairness, I will be paraphrasing the agent’s response to my question. Nevertheless, I’m in no doubt of the result. The general gist of all my questions could be summed up by one question and that is since we are being transferred back to the NBC is it guaranteed that we will incur an interview? In more than one response, and with elaboration, the mediator stated that after researching our case at the CSC office they felt no problem existed with our case and may they elected to send it back to the NBC to have our GC processed. As most of you know this is contrary to what we have heard here on VJ. So, after a couple of more times attempting to reconfirm the statement, the agent then did an about-face and said that once the NBC receives your case you will then be setup for an interview at your local office. After hanging up the phone my wife and I look at each other with astonishment.

In summary, I guess the good news is our AOS is not lost. As well, at least when we go to the interview it will be more evident that we are closer to getting my wife’s GC. Bad news is we will have to take yet another (10) hour around trip drive to our local USCIS office and bear even more expenditures. I was presently surprised how fast we received service via the phone. Please keep in mind, we are not complaining, because we know many of you out here are experiencing far more serious dilemmas. Not sure this helps anyone out here. Nevertheless, I thought I would share our experience with a follow-up post.
