it's been a month, no NOA1 yet

Hi VJ's,

we chose to have a lawyer though our case is not complicated. i'm on a tourist visa. my husband is a US citizen.before my visa expired,we decided to get married.we went to a lawyer,submitted the rest of the papers they need.we were missing one document and we again went back to the lawyer after a week to complete

it. we follow up once i guess from the time we submitted it. Its actually like 2 days after my visa expired when the Secretary emailed us and said she needs to see us to have more of our signature because she thought the lawyer was done with it. we actually communicate with the secretary's lawyer thru email.in my mind, the secretary's job is to finish or was the one responsible to file the paperworks and so on. and i think its her fault.its been 2 days before my visa expired before she filed the paperworks to the Chicago Lockbox. we were really upset of what she has done.she didn't prioritize us since we were there a month already after we have guven the rest of the documents they needed and she only about to send it after a month and i was already out of status?anyway,since we did use a lawyer,i think they send a lot of immigration forms at the same time compared to others who just send I-130 first.

My question is, its been almost a month and we haven't receive any NOA yet. is this all okay? any comments of what I have written? pls let me know.. thank you so much. and i hope you would give a spare time to read this.

Do you have a way to tell if they cashed your check? or did you pay the lawyers and then the lawyers used their own check to include the payment?

Kind of sounds like you have a secretary doing the work when you are paying the lawyer.. If it was me I would get my paperwork from them and information from them fire the lawyer and call USCIS and inform them you have fired the lawyer.

Usually the lawyer gets the NOAs and then informs you that they got them.

You could try calling USCIS and see if they can give you any info based on petitioner and beneficiary information and the lawyer that you used.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

I did not use an attorney. I had no problems!.. Hint My wife has her Visa and is now with me. Just waiting on Green card CR1.

The problem with most attorneys is they do not have the same priorities as you. They seem to drag their feet and in your case, they just complicated it more by dragging their feet. At this point, you should stay with them because they will have to explain to the USCIS if there is any problems on when it was filed and it was their fault and had nothing to do with you.

we actually paid the lawyer and i think they used their own check. we emailed the secretary friday last week and she told us that they haven't received yet any NOA so were still hanging here and waiting. we were really upset. my husband called the customer service and asked them if the USCIS received it already and they said, they don't have yet.. its stressing us out :( thank you for your response

Don't stress. Overstay is irrelevant/forgiven for spouses of US Citizens, so that doesn't matter. It sounds like your lawyer is really sucking and making up lies and excuses. Are you sure they sent it out when they said they did? Can you get a tracking number from them?

I have seen a few people having delays with NOAs lately, so maybe the mail room is just a bit backed up. Don't be too upset. Waiting is a part of the deal.

Don't stress. Overstay is irrelevant/forgiven for spouses of US Citizens, so that doesn't matter. It sounds like your lawyer is really sucking and making up lies and excuses. Are you sure they sent it out when they said they did? Can you get a tracking number from them?

thanks for those kind words. its actually on Monday next week that it has been a month since they send the paperworks. but i was just amazed of your timeline because you receievd results after a few days. we signed a lot of forms and they send those things that you have send too.like I-130/485, EAD and AOS.we also give them documents for my husband's taxes because the lawyer asked for it. im just trying not to stress so much myself and just keep on believing and praying.we emailed them on friday and said they havent received NOA yet and if they do, they would let us know.

you are right, overstay is irrelevant/ forgiven for spouses of US citizens. i think the lwayer mentioned that too.. and i really hope, everything will be alright. thank you so much.

Just a minor correction - lawyer would not have to justify anything to USCIS, why the application was late if at all it was late.

Lawyer could not be hold for not submitting paperwork on time.

USCIS is not going to question lawyer or fine/punish him for paperwork being late and give benefit of doubt to applicant.

Sorry dude you choose wrong lawyer, next time choose a better one - thats all USCIS would say.
