I-129F + Expedite, still no response, military

Hey everyone. This is my first time posting. I'm an active duty Air Force officer engaged to an Australian citizen. We filed our I-129F at the beginning of January and got our NOA1 a couple days after.

Approximately three weeks ago I received verbal orders of my next assignment. I'm assigned to Ramstein AB in Germany for approximately 3 years. The training timeline for the assignment has me leaving the U.S. in August. As soon as I found out my assignment, I submitted an expedite request to the USCIS. They replied in email with directions requesting supporting documentation. At the time of the request I didn't have paper orders so I submitted a signed letter from myself and my commander stating my situation and assignment to Germany.

Obviously, this assignment severely interferes with the visa/marriage process as I most likely would be leaving the country before my fiancee would get here (under the normal timeline). Not to mention that after we are married, we need to do the paperwork to make her a military dependent and get her medically approved to be on my orders to Germany (approx 6 weeks).

We submitted the letters by fax with coversheet and a copy of the email I received. The date was 29 March 2011; it's been about 3 weeks since then. We got no feedback as to whether our expedite documentation was received besides the fax machine saying "Sent Successfully". According to the USCIS My Account page, our paperwork hasn't been "touched" since January 8th. I've tried calling the military helpline but they don't really offer any more information than the national helpline and there's no way to call the actual VSC. I emailed them but the site says it takes upto 3 weeks to respond.

Just wondering if this is normal to expect or if I should making more calls or doing anything? I understand we have to play the "waiting game" but if the VSC doesn't receive my expedite documentation within 20 days of the request (which is well past now), the expedite is automatically denied.

Any help?

I have never been stationed there because I am in the Navy; but I passed by there serveral times and sometimes spent a couple of days there. I enjoyed it. Good luck!

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

So... shortly after my fiancée gets to the US and after we get married, we'll both be moving to Germany for 3 years on military orders. Anyone have any idea how that will affect the Adjustment of Status and her keeping perm. res. status? Isn't there some form or something we are suppose to fill out before we leave right away?

You will have to file for AOS, there is a guide on my signature. You should expedite that too. That is what were trying to do as of the moment, they will let us know within 5 days if the request was approved.

Bear in mind that the k1 is a single-entry visa.. so she needs to get married and file for AOS/EAD and advanced parole..with the advanced parole she can leave the country. If you get married and leave the country without filing for AOS and getting at least the AP then you will have to file for spouse visa via direct consular filing from germany.. something like that. I am sure the military will be more than happy to help you sort all these out. Goodluck :)

wow the rules of military expedite have CHANGED.back in our days,we tried to get expedite since my SO was going to get deployed to korea for a short period of time,no luck there.and the military hotline was #######.im glad troops get treated the way they deserve now,good luck OP :thumbs:
