K-3 I-129F Notice of Transfer?

Hello,

Today I received a notice from the NVC that they received my approved I-129F petition and that within the week they will be transferring it to the Montreal consulate. It says that my wife will receive a packet with instructions on how to apply for a K-3 visa.

It says the consulate is responsible for processing visa cases originating in the country where you were married. I was not married in Canada. Will this matter?

Anyways, a bit of history. Back in Nov' 2010 I filed both I-130 and I-129F for K-3/CR-1 (whichever got there first) and both got approved on the same day. It was my understanding that the I-129F/K-3 would be closed and they would proceed with the CR-1. If so, why this notice?

PS, yes, I know I shouldn't have bothered with the I-129F to begin with but I got some outdated advice at the time and it is what it is now.

It's possible the two petitions did not arrive at NVC the same day. You may proceed with the K3 or simply ignore it and proceed with the CR1. Please contact NVC and see if the two petitions arrived the same day. There's a chance USCIS has changed their policy of mailing the petitions so that they arrive together. I just called the NVC AVR line and they still claim the USCIS receipt # has not arrived with them. I also entered the NVC case # attached to the receipt # on the Notice of Transfer and they have not heard of that one either. Of course, as has been mentioned on this board, the AVR is not always up to date so I will be contacting them to talk to someone later tonite.

If the K-3 actually goes through and it means my wife gets here quicker then great! If she has to do AOS later then so be it.

The AVR will NEVER have any information about the K3 visa. You need to speak to a human.

please get a Human at NVC, inquire solely about casefile status on the K-3 - not mention the I-130, at this point, at all.

Later, it'll still be up to YOU TWO which visa you chase after.

I do suggest, strongly, you run with the CR-1/IR-1 visa

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
