My SO got here roughly two months ago and we didnt bother to get the SSN yet. Was told by a rep over the phone that it was pointless and to come in once we got her GC to avoid any issues.

Does it hurt to wait or should i go now?

Gary has stated this numerous times, yet anecdoatal evidence has suggested that not everyone has been able to successfully apply for a SSN immediately after entering. We tried approximately four days after entry and were told to try again later. I know that Gary's experience was different. However there is a strong reason for VJ Guide suggesting that people wait and that is it ensures that one shall not wait three hours in a SS Office lobby only to be told to come back later to try again.

You can try the next day, but there is no need for that. I suggest you wait about two weeks.

This is because you ran into an ignorant person and left before you talked to someone that knew what they were doing.

The reason is for the SAVE system to update. That is done each night at midnight.

How about the I-765 form? does that not apply for k1 visa ?

Says that you can use this whilst applying for an AOS and i guess this will be issues sooner since it says that u can work while waiting for your aos approval

please correct me if i am wrong ?

You can file the I-765 for an EAD with the AOS. It takes 2-3 months to receive the EAD. You cannot work until you receive the EAD.

You will need to have a certified copy of your marriage license to submit with the adjustment of status. This is obtained from the jurisdiction where you marry. This will take a bit of time for the marriage to be recorded in the official records.

How long? I am sure it varies. Best bet is to ask at the clerk of courts / county clerk office where you will marry.

Correct. By asking ahead and arrangling it with the JP that did the ceremony, I got the certified marriage certificate about 3 days after our wedding and drove to Montpelier to pick it up rather than wait for mailing.

So going back to the SSN thing... I was reading the form to apply with and it said something about having to provide a reason for needing a social security card if you are not legal to work in the US. Sooooo what do I say? Do I need to wait to get the EAD before applying for the SSN?

Your reason is that he is a K-1. K-1s are default classified as "work eligible" by SS so they can receive a number. This is because some jurisdictions used to require an SSN to get married. Since he is, according to their records, "work eligible" (even thoguh he isn't) you do not need a reason. You need his passport with visa and a clerk that understands how it works. DO NOT leave until you have successfully submitted the application. See as many supervisors as necessary.

Go now. It is not pointless. SSN is valuable for a lot of things.
