Actually that isn't true. There are residency requirements that the parent must meet also for a foreign born child to be considered a natural born citizen. Probably a good bet that the OP meets these requirements.

That's never actually been established. The constitution requires a presidential candidate to be a "natural born" citizen, and numerous court cases have held that they cannot have any allegiance to any foreign country.

So far, only two presidential candidates were born outside the United States to US citizen parents, but neither were elected - George Romney (not Mitt), and John McCain. Romney was born in Mexico but was never eligible for nor granted Mexican citizenship because neither of his parents were Mexican citizens. Congress passed a special act recognizing McCain as a "natural born" because he was born on a US military base in Panama.

Before the 14th amendment, it was generally accepted that "natural born" meant born on US soil. Section 1, article 2, contained a special exception for people who were US citizens when the Constitution was adopted. This "grandfather" clause was included to allow the country to have a president during it's early years since, technically, the United States didn't exist when any of the founding fathers were born, so none could have been "natural born" US citizens.

The law has never been tested with a president who was not born in the United States or a US territory, and who holds dual citizenship.

you dont need visa for your son,you must apply a CRBA and PASSPORT of your son because his automatic american citizen because his father is US citizen...apply CRBA AND PASSPORT now...

It’s not ‘automatic’ you don’t understand the application process.

Did you recognize the child as yours? If so, He is american because of you if you recognize him in your embassy. I am little confused. :wacko:

The child/applicant must meet the legal requirements pertaining to legitimation, out-of wedlock U.S. citizen father and non-U.S. citizen mother, recongnizing the child is only one step in the process for the CRBA the US parent(s) must meet US residency requirements, the US citizen must prove that he or she is the biological parent of the child born abroad, ether with documentation or DNA including making an appointment at USEM of the child interview. before an original FS-240 is furnished to the parent(s) At this point the child was born in the PI and is a PI citizen, not American or dual citizen at this point.

Pleas read the link that was given to you above, look underEvidence of the couple’s relationship prior to the conception of the applicant. Click on DNA Testing Procedures . you need to do the research /investigation into the subject of DNA ‘cost’ I have no clue of your method(s) of choice, i.e. what AABB accredited lab you pick or if this will be done inside the PI for both child and US parent or child in PI, US parent in the US?

Hi Guys!

I just recently join this website and i found it really interesting. I met my fiancee in the Philippines about more than 2yrs ago. Before our firsts anniversary we had a new baby and his a boy, his going to be 2 yrs old on October.

I filed a I-129F petition on Oct. 29 last year and receive our NOA1 on Nov 1st. 2010 and still waiting for our NOA2. My question now is that since we have a son now how will this affect my petition and since its going to be a K-1/K-2 Visa category why is it that its taking so long for USCIS to approve my case? it has been over 5 months now and i'm kinda worried. Please anyone who is familiar with this kind of situation feel free to respond or give any advise. I'm a novice here. thank you....

First of all I just want to say thank you for posting this thread bec. we had a similar case and it gives me an idea to file my son for FS-240, but the only thing my son is born in Canada and his going to be 2 yrs old too in Oct. I was originally filed my I-129F on Nov. but I got denied due to lack of initial evidence but thanks to this site who help me what to send to my petition. Thank you once again. Btw I'm from the Land of the Pearl too.

congrats for your kid and i have to tell you that fact youhave a kid 2ogther so its more easy for you to get for your fiancee a visa just take the kid with you to intervew , but let me ask you that cuse i dont know about happites and coustems in your fiancee country cuse it can bring alot of issues if having a kid without marriage is against her happites and coustemes ( i dont wanna b mean or nothing ) but the counsler can be a smart @s.

and ask you why you dont get married until now

06-23-2009 : my fiancee secound visit me in Egypt ( stayed 6 weeks ).

06-28-2009 : ENGAGED

10-29-2009 : I-129F Sent

01-27-2010 : my fiancee 3rd visit to Egypt ( stayed 6 weeks ) .

02-09-2010 : travel with my fiancee to turkey in a vacation (5 days)

05-25-2010 : my fiancee 4th visit to ( stayed 2 months ) .

06-03-2010 :Interview Date .

Interview Result : approved ( ya right ! )

07-01-2010 : we got a letter had my passport and over the visa stamp says ( canceled without prejudice )!!

06-29-2010 : case sent back to usa !!!

07-07-2010 : MARRIED

01-12-2011 : the letter state the k1 case is expired , and ther was no prob to file back for any kind of visa

04-25-2011 : my wife here now visiting me in egypt for 2 and half mounth yayyyyyyyyyyyy

05-18-2011 : travel with my wife to malaysia in a 1 week vaction

06-14-2011 : register our marraige papers in cairo
