Hi Guys!

I just recently join this website and i found it really interesting. I met my fiancee in the Philippines about more than 2yrs ago. Before our firsts anniversary we had a new baby and his a boy, his going to be 2 yrs old on October.

I filed a I-129F petition on Oct. 29 last year and receive our NOA1 on Nov 1st. 2010 and still waiting for our NOA2. My question now is that since we have a son now how will this affect my petition and since its going to be a K-1/K-2 Visa category why is it that its taking so long for USCIS to approve my case? it has been over 5 months now and i'm kinda worried. Please anyone who is familiar with this kind of situation feel free to respond or give any advise. I'm a novice here. thank you....

I am a bit confused. If your son is 2 years old why did you not apply for him originally?

My fiancee and I decided to just go ahead and file for I-129F since I can include him on the petition under Part B (list all children of your alien fiancee)

and we weren't sure how to acknowledge him as a son of USC. is he automatically a U.S Citizen since I'm a as his father a USC?

He won't be issued a visa if he has claims to US citizenship. File the CRBA with the consulate to get the child a US passport if the father meets the residency requirements

You should ask for an appointment at the consulate for him and make sure you meet the requirements and bring everything you need ( for him )

If the father of the boy is an American citizen, so is the boy and the father needs to register his birth at the consulate and get him a US passport. He will not be a K2. This has no affect on your K1.

If the child qualifies for US citizenship due to his father being a US citizen (certain requirements apply) he WILL NOT be issued a visa. It will be denied based upon his citizenship. You need to contact the consulate to see if he qualifies for a Consular Report of Birth Abroad to establish his US citizenship.

Question about the K2, visa. when paying for the visa at the consulate, do I need to pay for K1 only that covers the K2 or do I need to pay for both?

The fee is for EACH application. You pay for both.

This was my experience with the process at the US Embassy in Manila.

I recommend that the US Parent be at the interview. Both my wife and I was present .

Application are accommodated by appointment only

. When I was in the PI I did mine as a drop in case with my daughter because of time constraint and got the interview four days later. Can't say that it will work for everyone.

One thing for you to be concerned is For out of wedlock children But I must emphasize all of the documentary evidence on part 9

For me the main things they looked at was physical presence in the same location at applicant's time of conception, ultrasound and pre-natal care records, they never ask for pictures or looked at the one's I submitted." but never say never"

They talked a lot about DNA

and my case was bullet proof so just be prepared.

Don't forget you have to bring the child with you they want to see him/her.

This is my list of documents that I submitted to the US embassy in Manila for CRBA.

DS-2029 with 2"x 2" full face passport photo with white background. (child)

NSO true copy birth Cert. (child)

Passport application. (child)

Proof of parent US citizenship.

1) US passport.

2) True copy of live birth cert. with original seal of vital records office. A must have!

3)High School transcript ..(Yeah funny, but I'll tell you more about it later it's not a joke)

4)True copy of NSO Marriage cert.

5) Proof of physical presence in same location at time of conception. Airline tickets, copy of visa stamps.

6) Proof of mothers pregnancy, ultrasound, pre-natal records, hospital billing statements, and pictures.

Now about the school transcript you as a US citizen have to prove you are a citizen, you have to show that you have been living in the US for 5 years two after age 14….. They will not take your tax returns as proof, I can tell you why but I don't want to write a small book about it. When you give them your school transcript they take them with out a word…Had her US passport and CRBA cert. in about 10 days at my wife's home. PI.

Note: If your child is in the PI with only CRBA and US passport, you need to make sure you get your child his/her PI passport if you do not your looking at costly fees from the BI, exit permit and or late fees. One plus is with both US and PI passport your child will have Dual Citizenship.

If both parents were U.S. citizens when your child was born, he/she may have acquired U.S. citizenship at birth, if at least one parent resided in the USA prior to the child's birth. If a child was adopted by an American citizen(s), or if the U.S. citizen parent has not met the physical presence requirement, then the child cannot be issued a Consular Report of Birth Abroad. Please refer to the Child Citizenship Act of 2000 for further information on how to document your child as an American Citizen.

Note: Some posts can only accept an original Registration of Live Birth - bearing the impression seal of the Vital Statistics office. This record is kept on file with Vital Statistics and a certified photocopy bearing the impression seal of the office can be issued.

This document tells us whether there have been any amendments to the record. The child's certificate of birth is not always acceptable. Please refer to your "post specific" instructions when you receive your application forms, for acceptable birth record instructions.

2. Evidence of Parent(s) U.S. Citizenship at the Time of the Child's Birth.U.S. Passport; Certificate of Citizenship/Naturalization; Consular Report of Birth Abroad; or a U.S. Birth Certificate bearing the impression seal of the Vital Records Office and the date of filing.

3. Proof of parents' identity: Photo ID.

4. Child's ID (i.e. a vaccination booklet or Medicaid card or other passport).

5. Previous CRBAs for other children in the family

6. Original civil marriage certificate of parents.

7. Documentary evidence of termination of any previous marriages of either parent (i.e. divorce decree, death certificate, etc.), if applicable.

8. In some cases the U.S. citizen parent may be asked to complete an Affidavit of Parentage and Physical Presence at the time of Application.

9. Parents' Canadian Immigration Record, showing original entry date into Canada.

10. Evidence of parent's physical presence in the U.S.

My fiancee and I decided that I should go ahead and make a trip to Philippines to report a CRBA for my son. However I'm concerned about the K-1 petition I have with USCIS. Should I call them( USCIS here) let them know about the situation or just wait until my NOA2 comes? I also want to thank you all who gave me advise and replied to this matter. I appreciate your time and effort. good luck to everyone on their visa journey.

I came totally unprepared for the ROBA, we did have the school transcripts tho,

I am pretty sure that the consulate told me that a child eligible for a US passport had to enter the US with an US passport, could someone confirm?

I scheduled the interview while I was still pregnant and It was on my due date! I went there back from the hospital with a 12 days old baby, they grilled my husband to know if he was gonna support his son, It was a little intense but It went well!

It is in your best interest to be there :) schedule ahead of time as well I was surprised they were really packed
