Hi All,

Couldn't seem to find any info on this forum on this - or it could be because I haven't yet had the chance to really wake up :wacko: Anyways, my fiance is getting his employement letter and he doesn't work on an annual salary, just an hourly wage with lots of overtime hours! So, should he just get the employer to say that he has an hourly wage of $___, with $___/hour overtime paid beyond a 40 hour week? He is a full time, permanent employee.

Man, don't I just know how to sweat the small stuff!! :whistle:

Any :help: is greatly appreciated! Thanks!

My hubby also gets hourly paid, his employer just stated that he is a full time employee and gets $ XX.XX per hour. No problem at all for us.

If he has copies of past 6 months pay stubs, have those, and a copy of past 1-3 years tax returns.

To calculate annual salary I would take hourly x 35hrs x 52 weeks. Exclude the overtime because mostly cannot count on having overtime pay, and some employers try to limit full time at 35 hours a week.

If annual pay using the formula above dose not meet the 125% rule, then start adding assets.

See form I-864 for clearer explanations of income and assets, you may or may not be able to use I-864 at the visa interview though.

See form I-864 for clearer explanations of income and assets, you may or may not be able to use I-864 at the visa interview though.

I-864 is for AOS. For K1 interviews, I-134 - that may be asked but the consulate/embassy - check packet 3 for instructions. Most consulates only require 100% above the poverty guidelines.

I only offer advice - not even legal. Just the plain and simple kind.

I bring this up here because it had seemed improper in one of my prior postings. At that time i had written I-134AOS and it had seemed to be a wrong statement...well, i think not!!

On the USCIS website, form I-134 is also called AOS. So AOS, much as the term is used mainly in regard to form I-864, can also be used to qualify form I-134. So as far as i know, I-134 is the AOS for non-immigrant petitions while I-864 is the AOS for immigrant petitions.

When i called my statement "I-134AOS" tautology, that may well be however it is not wrong to call form I-134 affidavit of support.

Ah. I see what you mean now. AOS is an acronym we use in VJ meaning, most commonly, Adjustment of Status. But it also stands for Affidavit of Support, thus the confusion.

I only offer advice - not even legal. Just the plain and simple kind.

I'm hourly as well, just calculated a regular 40 hour work week (before taxes and deductions) then multiplied that by 52, this is my annual pay. Actually I'm in the military (National Guard) so I added that into the mix, for proof of that income I gave my fiancee a few of my LES's (military paycheck stubs). But still, even without the military pay I still make above the 125% of poverty level.

2006-10-16 11:15pm VISA APPROVED!!!!

2006-10-29 Xiang and Qi arrived in Detroit, immigrations 2 1/2 hours, finally holding my sweetheart in my arms.

2006-11-05 Exchanging our vows, what a beautiful day for our wedding!
