Does marriage status (of child) affect application process?

My mother-in-law is a US citizen. She wants to bring my sister-in-law.

Does it matter whether or not my sister-in-law is married? Is the process longer for a married child?

She's in her 30's and currently engaged to a guy with a US work permit.

no it does not matter if the child is married. however the process will take 3 years longer when the applicant is married.

Yes, if she is unmarried and over 21, her preference category will be F1, which has a current priority date of 1 May 2004.

If she is married, her preference category will be F3, which has a current priority date of 1 May 2001.

Why doesn't the fiance petition for the sister in law to bring her here to marry?

Maybe because the OP mentioned that the boyfriend has a "work permit" which is not necessarily implying that he is either a permanent US resident or a US citizen...

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Go confidently in the direction of your dreams. Live the life you have imagined.

@ricardo4eva2 - I would say that adding 3 years to the process definitely affects it :-)

@harpa Timsah - that's what I was going to ask. About how long does it normally take if she stays single?

@Barbara J - (I can't rid of this bold font) as the other commenters pointed out, the boyfriend has TPS status.

I imagine it will take longer if he brings her either as his fiance or as his wife.

that's not what is being asked. The person wanted to know if it matter if the sister in law is single or married for the parent to petition for her. Yes it is longer.. but no it does not matter if the applicant is single or married.

Does it matter whether or not my sister-in-law is married?

The question asked require a yes or no answer and the proper answer is no but thanks.

Second question asked if it takes longer and as we know - yes.

As Harpa said, it takes about 7 years if she is single, 10 if married.

@ricard4eva2 - no need to get excited :-) I wasn't trying to offend you. We're not understanding each other when I say "matters"---you're answering it from the immigration service's point of view (it doesn't matter to them) but I was asking the question from my future brother-in-law's point of view (it matters to him---adding 3 years to the process does "matter").

@penguin_ie. Ah that's what I didn't understand. So it'll take 7 years.

Holy cow! That's a heck of a long time.

Thanks for all the replies.
