Hello,

I have a son who is 12 years old and he got a visa last summer of 2010. He has not visited the United States as his passport came late in July so he cannot miss school and visit United States.

Me and my wife went for an interview for a B2 visitor visa and he asked us about my son. I have given him the answer that he has a visa but he didn't go as his passport came late but he is planning to go this summer and we all will go together if we get the visa today.

The interview officer ask me for his passport to see his visa and verify and I have handed him the passport. After given him the passport he went inside for couple minutes and return with the stamp on his visa with "CANCELED WITHOUT PREJUDICE" and denied us for the visa.

I tried hard to ask him the reason for his cancellation and in return he was not ready to reply me anything. He was keep saying Sorry Try Again.

As you know he is only 12 years old and he waited almost a year to visit US this year in summer but now his visa is canceled.

Do anyone have an idea if we re-try for the visa just for him he will get the visa? Even though the visa was canceled without prejudice. I have tried contacted the embassy regards to that and they are telling me to re-apply.

Any suggestion or any previous cases similar that will happen to them.

Please advice or comment on this.

this is crazy. it seems they cancelled it because they knew the parents did not meet the eligibility to be issued a visa.

At the time of interview for my son, the officer interviewed me as he is a minor and they usually interview the father.

You think if I re-apply right away like next week or so, you think there is chance of getting him the visa or he will be denied?

i think maybe they think if they issue you all the visa that you guys will go to the US and try to adjust your statues

and not return. but still i thin it was extreme to cancel the child's visa. deny the parents but leave the child alone

do you think you might have said something in your interview that might have worked against your son?

either way am sorry to hear this, just try again for the boy alone.

There is always a chance to have a different turn after stronger ties etc have been established. please dont let any one here or else where convince you not to try again the the future

Yea I am planning to try for my son alone as he is really upset that he was ready to go to US for 3 weeks in Summer.

We have went to all over the world but the only place that he did not visit is US and he wanted to go so bad.

I have big business in Pakistan and there is no way I can move to US and close all my business in Pakistan. I have shown enough proof about my business and I travel every month to another country for business purpose.

Who like to close his own business and go to US and work for someone?

Anyways, I am hoping for the best for my son's visa.

I will re-apply in couple weeks. Lets hope for the best!!!

My thoughts are CO was not conviced your son would return back, he would seek admission in school here and would try to adjust his status, as you mentioned you have big business means you have enough money to support him for the school here.

Unfortunately pak is high fraud country - where ppl have misused their visa all the time.

You can try again and see what happens, but normally its always difficult to get visa for teenagers.

There are several reasons that they can revoke a visa using "cancelled without prejudice". Given the circumstances, one guess would be an administrative error, ie. the CO believes the visa should not have been issued to your son in the first place. A visa must also be revoked if it is removed from the passport in which it was issued so the CO may have also considered this if the visa was not in the original passport. It's unfortunate he chose not to tell you the reason.

The decision to revoke a visa is discretionary, but the CO's are also instructed not to do it arbitrarily. So he definitely should have given you a reason.

The good news - the "without prejudice" part means exactly what it says - that this will not have a negative effect on future applications for a B2. If they had revoked the visa with a reason, it would have potentially been detrimental towards future applications.

So, I went with my son and re try for only him and ask them about the reason of cancellation as I have done the research and found out that they have to give valid reason for canceling the visa.

The lady was really nice who was taking my interview today with all the details over all again which was just formalities she was doing and explain me the scenario, as she mentioned that my whole family is not qualify for a B2 visa and we don't pass the criteria of visa what they go by.

So they have denied the visa for my son and said you can try again in future.

I just feel very bad for my son who was planning to visit United States for a year now but oh well, seems the country don't like us to visit there country which is absolutely fine.

I will take him to a world tour this summer.
