Travel or Student Visa while waiting for CR-1 Visa

Hi all,

I was wondering if anyone knows if it possible to get a travel or student visa while waiting for a CR-1 Visa. My lawyer said its basically impossible and not recommended because even if they give it to you at the consular post the port of entry will reject you. But it seems so unfair, especially considering some people have to wait years for the green card to come. Has anyone successfully gotten the travel or student visa and entered the US while the application for immigration is in process? If so, what kind of financial qualifications, ties to the home country did you have?

Both of those are non-immigrant visas. How do you expect to answer the "Can you show me ties that you MUST return to Yemen?" When obviously you have immigrant intent with your pending cr-1?

When I applied for my student visa, the bar was set pretty high at ties to return.

Tourist visas are another non-immigrant visa. Lots of people travel to the US, however obtaining a tourist visa from Yemen might be difficult with a pending Cr-1

There's nothing that says you can't try - but you will risk losing not only time but money in those applications, that most likely will be denied since with a pending CR1, proving non-immigrant intent is virtually impossible.

To be eligible for a student visa, the applicant has to be first accepted to an accredited school here in the US, and then prove sufficient funds to cover all the costs of attending school here. This means not only tuition, but insurance, transportation, books, rent, food etc. Schools have their own estimates of annual expenses depending on where the school is located. Depending on the tuition and the living expenses, annual expenses can be anywhere from 20,000 to 60,000. In my school (university in NYC) annual expenses were somewhere around 45,000. For first year, the applicant has to show liquid funds sufficient to cover those costs, and for consecutive years access to sufficient funds. After this, the applicant would get an I-20 form from the school, and with that I-20 form go to an interview at the local US embassy or consulate. The applicant might be able to get to this point - but they will know at the embassy that there is a pending CR1. And that would most likely be the end of the road.

Don't know what the chances of a tourist visa would be. As I said, you can of course try - but just be aware of the odds.

Husband has received a full scholarship, we have not yet started the CR1 process, but about to, but I'm worried it will take too long and he won't be able to go to school next fall 2012, wanted to see if we can do a simultaneous application for F1 and I-130.

you can apply simultaneously, most likey F1 would be rejected. Sorry cannot get best of the world everywhere... :)
