Timeline

Hey All,

So here goes. In April 2002 I met my husband online. I visited him in August 2002 and submitted the K1 paperwork in 2003. (application fee was 81usd at that time!!) He was approved for K1 in March 2004 but decided to return to his home country instead. In 2005 I visited him in his home country and applied for K1 a 2nd time and was approved. He arrived in February 2007 and we were married. All immigration paperwork on time and complete, however we are divorcing and it will be final June 23, 2011. So...

I met Khalid in October 2010 and we became friends. Our relationship turned romantic in January 2011 (my 1st visit) and we would like to marry once my divorce is final. My questions are...

Should we submit K1 paperwork once divorce is final in June or marry on my next visit to Nigeria hopefully in August 2011. Either way my next visit will be in August wether for marriage or just a visit.

My heart wants to submit K1 but my head says CR1 what do you think?

If you can get married, get married! I was in the same boat as you last year. I got divorced and submitted K-1 visa petition. Was approved at USCIS and the the Consul officer denied the visa because he claimed you cant be married and engaged at the same time. I tried to explain I was separated for 5 years before I my divorce was final, but he didnt care and denied the visa. Had to get married and start the process all over again.

Considering your past history with online romance - I would suggest you visit him - and if the mood is right, get married, then file for the CR-1.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I think ur correct on this. The overlap of marriage/divorce becoming final and engagement does complicate our situation. Thanks so much we've decided to get married and apply for CR1. We should have 3 or 4 visits under our belt by the time of his interview. Thanks again.

I would susgest that you slow down a moment. Some people see that you have already been used and look to see what they can get out of you. I susgest that you work hard on your job then take 3-months or more to spend quality time with your new flame. You will get a better feel of things the longer you spend there, heck If you could take leave and go there for an extended period of time, he should be able to take care of you, you seem like a giver, and some in Nigeria are pure takers, until they are finished using you. Take caution, with all money your spending traveling to Nigeria and I would advise you against sending your new flame one penny of your money.

RFE - received in mail March 29th,04

RFE returned April 17th,04

RFE received April 21,04 at NSC online

NOA2 received April 29th,04 via online

NOA2 received May 03,04 in mail

NVC receives file May 6th,04

NVC sends file to Nigeria May 11th,04

Lagos receives our file, notified thru e-mail May 19th,04

Victor goes and picks up packet #3....May 20th,04

Sent request for earlier interview date via e-mail May 20th,04

May 27th, Lagos won't change date.

August 16th, 2004 fly to Nigeria for Victors interview

August 19th, 2004 Interview date, visa approved.

August 25th, 2004 Victor picks up passport with visa stamp.

August 26th, 2004 fly back to USA

September 18th, 2004 Victor arrives in USA, Lord willing.

October 9th, 2004, we become husband and wife

October 25th, 2004 I learn that I'm pregnant.

Feburary 25th, 2005 AOS Appointment

( went to appt. and requested a reschedule)

June 7th, 05 gave birth to a boy child.

July 5th, 05 Victor packs he suitcase and leaves for good.

July 2005 2nd AOS appointment

( went and requested a reschedule )

August 2005- I file for divorce. and withdraw immigration paperwork.
