Hello Everyone!

Will the US Embassy refuse to give a K1 visa if I am not at the interview with my fiance? How imortant is it? I believe we have a trong case. We have phone records. calling card records, cards I mailed her, passport stamps of my visits to Ukraine and her visit to the United States, photos, phone text message records, daily skype logs, airline boarding passes, photos with my family and friens and also her friends and family, etc. Elena believes I do not need to be there. She feels very confident and will be attending with her son, who is 18 years old. What are your thoughts?

Thank you in advance,

Mehmet

No - they will not refuse it. It's based on other things that is provided in the petition/application. Plenty of USC's do not attend the others interviews for the K-1.

If your case is strong - I would not be worried.

If it wasn't - I would probably be there - however, you would not be able to attend, or even enter the embassy for this - depends on the rules/regs of that paticular embassy.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

You do not need to be there. I always suggest the USC goes. I did and I was glad I did. But no, it is not necessary and in itself has NO bearing on whether a visa is issued.

Kiev does allow the USC to attend the interview. I walked right up to the window with Alla when they called her. No questions were asked, they handed back her original documents and said she was approved.

I could not go (Volcano!). We had no problems. If your relationship is good and your docs are good you will be fine....
