Hi Everyone,

We filed for our K1 visa in Dec and will soon approach the 5 months mark in May. I've read several times that people have contacted their congressmen/senators to escalate the matter.

Does anybody know who I should contact if I live in Toronto? I know this may seem like a silly question. But, is there somebody specific. Or I can find over google?

Thanks!

I would suggest the representative that serves the district of the USC petitioner. Not likely to find anyone in Toronto that will be of help with US immigration matters. Good luck!

The US citizen petitioner needs to contact their rep or senator.

I wonder if the question is implying that the USC petitioner is currently living in Toronto? A USC can file an I-129F while living abroad, according the the I-129F instructions.

If this is the case, it's a much more interesting question, though I don't know the answer.

Even when doing DCF, some US domicile is required, no?

If the USC has no domicile, and isn't going to be able or doesn't want to get any, that might be a situation where they would want to file an I-129F from outside the US.

When approved, the petition would be sent to the NVC, then to the beneficiary's local consulate, where they would get a normal K-1. The USC and the beneficiary could then enter the US together, the USC as a returning citizen, and the beneficiary as a K-1 entrant, with no preexisting US domicile strictly required, I think.

I know the I-129F and the DS-15x consulate forms ask for the location the beneficiary intends to live at, but I can't think of anything offhand that would prevent this from being a workable path to a K-1 visa, in the case where the petitioner is living with or near the beneficiary outside the US. It would clearly be an unusual case [since normally, reestablishing domicile and going for DCF is so much quicker and cheaper than the I-129F->K-1 path], but it seems doable to me.

Thanks Everyone for the response!!!

I am actually the beneficiary living in Toronto. My fiance lives in the states. So he should be contacting his senator/congressman. Makes perfect sense. =)
