proof of paying taxes

Hey all,

I am a U.S. citizen and a PR in Canada and have paid taxes in Canada for 9 years. How does that fit into a 864

or 134 as Affadavit of support at a DCF with an I130 work to be able to take my wife to be from Canada to the

U.S.? I have income from both countries but file in Canada.

Any ideas?

I looked at the instructions for the I-864 and see a complication, but then again I am no expert, and you may want to contact a tax expert.

If you read the instructions included with I-846 it indicates on page 8 paragraph 6.

If you were required to file a Federal income tax return during any of the previous three tax years but did not do so, you must file any and all late returns with IRS and attach an IRS generated tax return transcript documenting your late filing before submitting the I-864 Affidavit of Support. If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a written explanation. If you were not required under U.S. tax law for any other reason, attach a written explanation including evidence of the exemption and how you are subject to it. Residence outside the United States dose not exempt U.S. citizens or lawful permanent residents from filing a U.S. Federal income tax return.

So I would talk to an immigration attorney, and if you need to a tax accountant about the tax situation.

You may want to start a timeline, and add some more to your profile, you will get more responses if more info is there helps us know the details of your situation. Like type of visa K1,K3, DCF... Service center, and so on.

Recognize that as a US citizen you are required to report your income, if it is above the specified minimum, to the US IRS no matter where the income is earned and no matter where you reside. You may not owe any US tax on the income, but you must report it.
