The people at USCIS didn't give you outdated information. They will accept, process, and approve the I129F for the K-3. it is NVC who closes it, if you call NV they will tell you the 129f will be closed

Im just curious as to how its not outdated information if they no longer process them at nvc... The uscis obvisouly knows they automatically close them so why dont they take the information down and stop accepting them? It doesnt make sense. Its just adds to the complication of an already complicated ordeal. I understand they are two different places but its all part of the process to get family here.

The "why" is a good question to ask. First, since they are separate government agencies with long running turf wars, they tend to play these games back and forth. At any day and possibly already, USCIS could subvert the NVC's petition closing policy by beginning to forward the petitions separately, with the I-130 following a couple days after the I-129F. We've actually seen one or two instances of I-129F's arriving ahead of the I-130 just lately. A couple data points got my attention but is not enough to establish there's any new trend or policy.

You see, USCIS used to process these petitions at separate service centers and independently. That policy changed in November 2006. Since early 2007 NVC has been getting two petitions arriving together, so in early 2010 they reacted by changing their definition of Immigrant visa, "immediately available" from I-130 on station at a Consulate, to I-130 at NVC. USCIS is free to change policies but cannot

rescind the Life Act. Only Congress can do that.

Facts are cheap...knowing how to use them is precious...
