I will soon file I-864 for my wife. But at this moment I am not working because I am comleting my MS. I also don't think I can get co-sopnser. Following is my way to work things out tell me if this will work??

1. On my 2005 tax return I had enough income ( me + sister as a family member).

2. I have cash and asstets that is larger than req income times five.

3. I have a friend who owns a corp who can write an employer letter and pay stubs.

So, my friend's letter and pay stubs combined with asstets are enough for I-864??

Pls advise me.

I-130 process:

02/28/06 I130 sent to VSC

03/10/06 NOA 1

06/12/06 Touch (address change)

09/12/06 NOA 2

I-129f Process:

07/23/06 I-129f sent to Chicago

07/31/06 NOA-1

08/16/06 Touch

NVC Process:

Hurry up pls!!!!

09/25/06 DS 3032- Gen

09/26/06 DS 3032 email sent and I-864 fee mailed

09/27/06 DS 3032 accepted

09/28/06 I-864 fee is rec'd by SL

10/03/06 NVC genarates I-864

10/19/06 Rec I-864 ( I waited for orig. form)

10/11/06 IV bill recvd

10/11/06 IV bill sent

10/14/06 IV bill recv by SL

10/23/06 IV bill info in NVC sys (oprator verified)

10/24/06 send I-864

10/28/06 NVC sent DS-230

10/28/06 DS-230 sent to NVC USPS

10/30/06 NVC received DS-230

11/01/06 Massage on NVC line: "Your info packet is received pls allow 6-8 weeks to review".

6-8 weeks #######, I hope it takes less.

Only 3 times is now required. New Rules for the Affidavit of Support (I-864)

According to your post you are not working....yet also mention employer letter and pay stubs from a friend. Why risk a lie when it can have dire consequences, if that is indeed what you are thinking of doing.

You should be able to accomplish this on your own merits.

1 and 2 are ok and should stand on its own.

but number 3 is bad, if they catch the lie that you are proposing then BAD things can happen.

Honesty is best, and if your income Plus assets add up the go with that.

Perhaps your friend with the corp would do an I864A and be your co-sponsor?

Perhaps your friend with the corp would do an I864A and be your co-sponsor?

An I-864A is only used when one is a household member, not for a joint sponsor to use. A joint sponsor would complete a seperate I-864.

I agree with yu and dan, sounds like your income and assets are good enough, but don't try to lie. that could stop your spouse from ever getting to come in. also, every consulate has a different take on what exactlly they require. call them and see if they can shed some more light. good luck!!

7/1/08 - Removal of Conditions Window opens

7/21/08 - Sent paperwork off to CSC

7/23/08 - Paperwork arrived to CSC per Delivery Confirmation

7/28/08 - NOA received, postmarked 7/25/08. $545 Check cashed today also.

8/6/08 - Biometrics Letter received with an appointment date of 8/22/08

8/22/08 - Biometrics appointment completed

8/25/08 - Case status available online

11/11/08 - Approved!! Received GC in the mail today. They didn't change her last name like we asked, but I could care less right now.

Thanks for advise. I now realize that it is not a good idea to lie about employment.

But what if I indeed start to work for my friend officially. I have been doing accounting for him for about 3 years now. I got paid for it but never showed up on W-2 or 1099.

But I can get him to pay me via 1099 for this year. That is what I meant in the begining. Now if I get a letter of employment saying I started working for him from Jan/06 and I get 1099 at the end and file taxes with it, is it still a problem? I have been working for him but never showed it. But now I need to show it can I do that?

It is also wrong for your friend to pay you, but it never shows up on W-2. That is against the law. We absolutely do not support anyone who makes things up and does anything against the law.

There are many people who don't have enough income, but they can use their assets and/or get a

co sponsor. You can ask your friend to be your co sponsor. A co sponsor needs to fill out another I-864, because I-864A is the contract between the sponsor and the household member to have the household member's income available.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

What was your 2005 income alone? (If you don't think your sister will act as a joint sponsor for you, what makes you think you can use her as a household member? (If that's what you mean by "family member"))
