Hard to determine status based on postal notices - Sounds like a NOIR or D, K-3 casefile returning to USCIS for a review, US CONSULATE office, IV unit, not approving the K-3 visa application.

but

I suggest one thing - (unrelated to the NOIR/D on the K-3)

call into NVC, get a HUMAN - not talk about the K-3 status at all -

but

inquire about the I-130 status. IF the I-130 is still active at NVC -

you have a shot to chase after a CR-1/IR-1 visa, doing paperwork intake at NVC.

Can't say it's 100 percent do-able, but at least you have a shot, nowish.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Your post is very hard to decipher -

Do you mean your petition was approved at the service center, and then he was denied in JA at the interview? You don't have a timeline that enables people to tell what point you are at -

If the petition was approved at the service center, that does not automatically guarantee a visa - the actual interview at the consulate is where the visa is determined - If that is the situation you are in, I would start emailing the embassy and calling your congressman and senator for help - try to find out why it was denied before it gets returned to the US.

we were approved in 2010 we got married in 2009 does thids mean we are not legally married if they revoke i am so confused

If you were married using the proper channels, then you are still legally married. Immigration has nothing to do with your martial status. Immigration(USCIS) just doesn't believe that the documents you provided supports their reasons to approval a visa application for you'll.

We are going through the exact same thing, but we have about 60 more days before we receive our NOIR ( notice of intent to revoke) I no this cos our letter said we have to wait 120 days before contacting them if I have not received my notice..They said they are reviewing it for possible revocation.
