Hi Everyone,

My husband got a notice in February saying his green card was approved and that they were mailing it within 30 days. Well, 30 days came and went and we never received it. It got lost in the mail (probably somewhere in our apartment building) and they are saying that he has to file again (using an I-90 form) and pay the fee of $450 again. This seems crazy to me because his AOS was already approved, he just needs a new card printed. Does anyone have any advice? I sent a letter to our congressman's office today to see if they can help. We have followed every step exactly as we were supposed to. We can't possibly have to reapply and pay again.

If USCIS got the card back they could send it again, they wont tell you that they got it back, you would have to ask them if it was returned to them. If it wasn't returned then you would have to apply for a new card based on " lost green card " aka I-90 GC replacement and fees.

If you were able to prove it was lost by USCISs fault, they misaddressed it or something, then you wouldn't have to pay the fee for the replacement.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

First I'm sorry this is a huge pain BUT I just need to tell you they're NOT making him "file again". They asking that you send off for a replacement card. They're not telling you to "pay the fee again" because it's $1070 to file AOS, you're paying the fee for a replacement card. You're not going to get denied or attend an interview, there's no evidence or whatever.. he's STILL approved but he needs the card and he doesn't have it so he needs to send off for a replacement.

Do as Inky suggests and find out if the card was returned to sender. If it WAS then you can use option B on the form which means no fee. If the card was not returned to USCIS then unfortunately you need to pay the fee.

Your congressman will be unlikely to help because there's no proof that you haven't received the card and just want an "extra". Anyone who loses or misplaces the card needs to get another one. Yes it sucks that it's lost in the mail but unless you can prove that USCIS addressed the mail wrong, or they had it returned then you need to pay the fee.

when you called the uscis 1-800 number did you ask when the card was mailed to you.maybe it was not sent yet,if you file a 1-90 pay the fee 450.00 and it arrives then your out 450.00 call again ask when it was sent and if it was returned to the uscis,
