My now wife has a 16 year old daughter. We applied for AOS and EAD for both my wife and her daughter at the same time. Both of them have received their EADs, her daughter's came a few days before my wifes. They both had their Biometric appointments on the same day. We got an RFE for her daughter, which we satisfied with no problem. They processed the daughter's applications first according to the dates on the documents.

We then received a transfer notice for my wife's AOS application. After that we received an interview notice for her daughter. Since then my wife received her approval notice and Green Card. They both have received their Social Security numbers and cards.

Her daughter's interview is in 2 weeks. Do any VJ member know what questions they will ask her? I know her mother has to attend, am I required or allowed to attend also?

VJ members have been a great help in the visa process and I in turn have helped those that have asked about our experience.

I really don't see how anyone can get through this whole complicated process without the help of fellow VJ members.

Interesting. I thought the K2's status was derived from the K1's. If the K1 was approved, why wouldn't the K2 also be approved? Will keep an eye on this as I just filed for AOS for my wife and her three (K2) children. I couldn't imagine the kids being scheduled for their own interviews...

Your thinking is very much like my own. I think things got turned around when they processed the child's first.(The applications I-485 & I-765 , were sent in the same package for both my wife and her daughter.) The child is 16, so still a minor. There are 3 reasons that I thought might cause this situation. First is that the child's name is still VN.(My wife took my name.) Second, that they want proof that she is really her daughter.(They have all the documentation already, Birth Certificate,ect.) Third is that she lives with us.(I don't see how that matters.) The interview is scheduled for the 26th of this month, so all input will appreciated.

When we filed for AOS my Stepson was 17 and he was required to have a interview he was aked the same questions as his mother, from the I-485 I would also say to be there at her interview too, you are the one sponsering her, luckly my wife and stepson had the interviews schedauled on the same day. There is a forum for K-2's I have a link on my signature. K-2 is derived from the K-1 but now you have applied for Adjustment of Status.

I went for my AOS interview yesterday with my now husband....and my two biological children - they got letters sent to them seperately requesting interview....funny how their scheduled interview time was before mine....which is why I called immigration....

I wanted a sleep in and tried to adjust the times to later in the day....but was told...if interview is on the same day and time is close to each other...then they wont change it and I had to take the kids out of school...and my husband had to take a vacation day and we all went to interview.

Kids were asked NOTHING...except to raise right hand together and take the oath.

YOU Should call the Immigration centre as they have stuffed up the interview date...daughter should have gone with mother and usc.

that being said...youll have to go with mother again now...propably going to be 4 mins of nothing like mine....

Her mother already has her Green Card, without an interview. That is why I think it strange to have an interview for her daughter.

Please tell me what you mean by"stuffed up the interview date". Is it like overbooking an airline flight?

My son also received a seperate interview letter for the same day as his mother and he had to be sworn in just like her mother to answer questions, he was asked about going to a state university at the age of 17, how he liked the US, and asked what things he has done since he had been here, and like I said earlier answering question from I-485 maybe 5 examples are you a terrorist, deal in drugs. Now I noticed from your first post you said that you received a transfer notice on your wife's application, did the daughter receive the same transfer or stayed to a local office? It could be a reason she has to go to interview, but the best thing to do is go to the interview with her whether its being sworn in and answering 1 question or 5 it will be done and over with and after she gets her greencard take a nice break.

I hope you had a chance to read the K-2 AOS Forum, pretty much everyone in this forum has dealt with AOS for K-2's. You may want to ask the same question there. GOOD LUCK.

Thank you for your input. Yes, the reason my wife did not have an interview is because they transfered her application. Daughter's stayed at local office.

I am not concerned about the interview so much as wanted to lnow what to expect. You have given me what I wanted to know!

People seem to be missing the point. Yes, it's standard procedure to get separate letters for the K2 child for everything - NOA's, biometrics, appointments, etc. It's also standard procedure for the applications to stay together. I've never seen a case before where the K1 was given a green card without an interview but the K2 was required to interview. This is very unusual.

From the relative times you've given, it sounds like their applications got separated after the RFE. What was the RFE for?

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Hi Jim, Happy to hear from you again. Their applications were indeed separated, but from the very begining.The child's NOA1 came before my wifes.

The RFE was because I thought the 2 applications would be processed together. I did not send a separate I-864 for the child, a separate copy of the I-129f Approval Notice, or copies of documents that were included with my wife's I-485. Hence the RFE.

From the get go, when I checked the status on the USCIS website, the childs Initial Review showed up weeks before my wife's.

When I sent the original I-485 applications, I had my wifes in one folder and her daughters in another, then sent in one package to them. I am at work now, but I believe the Notice of Receipt for the daughter came before my wifes also, I will check when I get home.

I know it all sounds a little crazy, so your thoughts on this would mean a lot to me. You are one of the most knowledgeable people in the VJ family.
