Confusion with timeline

:unsure: Ok so my mom and my step-dad got married over a year ago. My step-dad, who is a USC have recently filed an I-130 petition for me. I do not live in the US. We have received NOA1 a couple days after the check was cashed on February 16,2011. We have paid all the fees, sent in all the documents asked for and have received no RFE(s). It's been almost two months and we haven't received a Biometric appointment. Here is the thing that I am confused with.

1. When filing the I-130 petition, is a biometric appointment needed in order to approve the petition?

2. If the biometric appointment is needed, is there a reason why we haven't received one as yet?

3. Should my step-dad and my mom make an Infopass appointment?

4. Also, when do we do the medical?

I know that a visa number will be immediately available to me but I have school coming up in August and would hate to be late or have to reschedule my enrollment.

I have another question, :ot: this is a bit personal. My biological dad isn't the best father in the world. In fact, he's told my sisters and I, that he regrets having us and he should be on his own. My sisters and I are under-age. We currently rent a house but the conditions are terrible and my dad has basically stopped contributing financially, emotionally, physically...and the list goes on. Oh, he also moved out of the house and left my sisters and I alone at home. The conditions we live in are deplorable. My mom and step-dad has to be paying the bills, rent etc, in order for us to survive. :ot2: Is it possible to get an expedite, from congress if we bring this case up to them under financial and/or humanitarian reasons? In addition, how long will the expedite take and is there a fee involved, i.e. if we decide to expedite? I haven't seen my mom in almost 4yrs (she was originally on a student visa) and I miss her a lot. I need your help. :(

The K3 visa was a spousal visa, your step-dad would not be filing a petition for that on your behalf. He would have filed the I-130 for a CR-2.

An expedite request is made to USCIS, not Congress.

December 8, 2010: Wedding date set; it will be on February 18, 2011!

February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

1. not for a CR-2/IR-2 visa - but usually some fingerprints are taken AT the embassy IV unit, many times on interview day.

2. appointments are never made solely for fingerprints for a CR-2/IR-2 visa. Methinks yer confused, a bit.

3. Only if you want them to appear to be 'un-read'.

4. AFTER NVC issues you an interview letter.

I think the probability of expedite is very low. Your situation is not enough of a reason to request the expedite for humanitarian reasons...as far as the financial - the cost of living that your mom and step dad would cover for you and your siblings in Jamaica is probably lower than what it's going to be in States (unless you're able to prove, it's otherwise).

Ask your mom and step dad to go to a lawyer (they usually provide a free initial consultation). I'm suggessting not hiring a lawyer, but check out what they have to say.

Hopefully you will get few of the senior members answering your query as well. Good Luck!

My mom came on an F-1 but since she got married to a US citizen, she received a K-3 visa... she is a green card holder now.

I know that but the cost of living here in Jamaica is almost three times the cost in the US :( We can prove the financial situation. Yeah, I hope so :yes:

some follow up -

you won't get any biometric appointment in the usa - but there will be some biometric INTAKE on interview day in Kingston, as your NOT in the USA, so no biometrics on YOU in the USA. Your mother had her biometrics done in the USA, as she filed an 'adjustment of status' case after being in the USA, not any 'apply for visa' casefile.

medical is usually done after the interview appointment letter is generated.

You've a long road ahead of you - still need the I-130 approval, still need action at NVC for IV and AOS and interview scheduling.
