Timeline

Hi everyone,

I have just found out that on the USCIS website you can submit an EAD request form via the internet. Would I be able to that that from England? Or do they need proof of me living in America?

11/18/05 - booked medical

11/24/05 - sent in Packet 3, happy thanksgiving!

11/26/05 - medical in birmingham

11/27/05 - embassy received packet 3 via recorded delivery

11/30/05 - received medical back from birmingham

12/19/05 - got police cert back - 40 days exactly!

12/22/05 - emailed embassy to hassle them for an interview date

12/29/05 - they emailed me back saying interview will be on Feb 1st

12/30/05 - packet 4 received in mail

02/01/06 - interview - APPROVED

03/09/06 - fly out to san fransisco

05/13/06 - Married!!

12/23/06 - Sent AOS

02/08/07 - Fingerprints

03/06/07 - More fingerprints!

04/27/07 - Emploment Authorisation Card arrives!!

04/30/07 - Interview date arrives

05/01/07 - Applied for social security number at SS office

05/30/07 - AOS interview

I've never heard of EAD applications being accepted via an online application. As for applying from the UK, even if online applications are an option, I am almost certain that you'd need to be in the US in order to do so.

You can apply based on a K-1 Technically, but that only lasts for the 90 days after you enter, so its not worth it to apply.. Really you have to wait until you are in the states and have married your fiance to apply, and that must be done with or after applying for AOS. Sometimes you can get a temporary 90 day EAD at your Point of Entry (POE), but not always.... Apparently you might have automatic authorization to work with your K-1, but i odnt know.. Mydyoung might know more about that.. (he seems to know everything just about..) I applied for an EAD on my K-1 and i was denied... I didn't know that i shouldnt and i'm still kicking myself.. shoulda checked the website!....

An employer (who wants to operate above the law) will require both an EAD stamp /card and a Social Security Number. Without those two you are legally unemployable.

You can get a temp EAD stamp if you enter the US via JFK but this is only valid for 90 days or until you get married (somewhat of a grey area). Once that expires, in theory you can't work again until you have an EAD card in your possession.

Most people find that even with the stamp from JFk, by the time they have arrived, applied for a Social security number, received the social security number and found a job almost the entire 90 days is used up already. It's normally less hassle to assume you'll be unemployed for a few months and to not bother applying for an EAD until you are married and submit an application along with your AOS application.

It is very unlikely that an employer would hire you with just a K1 stamp... you would need an EAD from POE and then its only valid for 90 days from entry... you will also need a SSN and that will take a couple of weeks to get... if you then start work and after your 90 days are up and you have not recieved your 1 year EAD that you apply for with your AOS you will have to stop work and wait for that to be approved and for you to receive the actual card..

In order to work you need a Social Security Number and authorisation from the USCIS. When you arrive, you will have neither. After arriving, you will have to wait for 2 to 3 weeks before you can apply for your SSN, then it takes another week or so to actually receive it in the mail.

Regarding the employment authorisation. If you arrive through JFK, you can ask for a stamp in your passport that, I believe, works like a temporary EAD. However, it is only valid for 90 days from date of entry. Beyond that 90 days, you must have a formal EAD from USCIS. To get a formal EAD, you must first get married and then file for AOS and EAD together. It will take about 3 months to get your EAD card in the mail after you apply and have gone through biometrics.

You should plan on not working in the USA for between 3 to 6 months after you arrive here. This will allow for any delays that you might run into.

Ditto to what the others said about getting a temporary EAD at JFK.

I believe that you can apply online for an EAD after marriage, but you have to back it up with proof that you have applied for AOS - so it is no quicker than sending it all off together with the AOS.

It's not worth getting the temp EAD from New York. It will run out by the time you get your actual EAD (in the vast majority of cases - you need to wait to get your SSN anyway) and then you'll have to quit your job and try and get rehired again.

Wait and apply for the real EAD after you get married, it will save you a lot of agravation even if in the meantime it means you can't work which, unfortunately, it just something you have to factor into the equation of immigrating to the USA.
