Hi all, I am trying to file AOS for my wife which came over on K-1 visa. On form I765, #16 it says

#16 go to part 2 of the instructions, Eligibility categories. In the space below place the letter and number of the category you selected from the instructions.

What do I put in the three spaces above, again my wife came over on K-1 visa. Thanks !!!

a6- if you are filling within 90 days from the date of entry.

I think it's ©(9)...according to what I've read from past forums here, use C9 if the I-765 is filed together with the I-485. As for us, when we filed I-765 concurrently with I-485, we used the C9 eligibility and I came here through a K1 visa..God bless..

2010-20-12 -Got our NOA1 letters in the mail for our I-485 & I-765...A wonderful Christmas gift for us!!

2011-19-01 -Received Biometrics schedule!!

2011-07-02 -Biometrics done!!..thanked God!!

2011-17-03 -AOS Interview..APPROVED!!

2011-24-03 -GREENCARD received!!..it's green indeed!!..lol..

If you got married WITHIN the 90 days but say filed AOS at like 100 days... would it still be C9?

If you filed your AOS before I-94 expired and got married within 90 days from the date of your wife's entry in the States, fill in with " C 9 " for question # 16.

Yes. C9.

Anyone with a pending I-485 uses C9.

About the A6 category: K-1's are eligible to apply for an EAD before they get married. This EAD, based on code A6, will expire when the I-94 expires, so 90 days after entry. Now, the EAD takes about 90 days to process. Therefore, if you applied for A6 before you got married, it would come to you about the time your I-94 expires, and then the EAD would expire, so at best you would have it for a few days. It's a waste of $340.

EAD applied in conjunction with a pending I-485 is free, and is good for a year. It is meant as a temporary measure until you get your GC, which gives work and travel permission by itself. If you were to put A6, your EAD would be denied because your I-94 has probably expired by now. I have seen it happen here when people put the wrong code.

It's C9.
