The DREAM Act has been around since 2001 and has yet to be passed. Last December was the closest it got to being approved. Will it be approved? Hopefully but you never know how long that will take and what will be changed in the proposal before it finally becomes law.

You and your wife will incur a 10 year ban if you leave, your children will incur a 3 year ban 180 days after their 18th birthday and a 10 year ban after 365. So you have that long to do your research into moving to another country (Canada?) or mayb you get lucky and during that time DREAM Act is approved. Good luck!

If Obama was really interested in this he would have done it when he had the majority.

Now he would have to horse trade, big time.

The Dems were not serious when the put it forward in the lame duck session, just playing politics.

Damn...Thanks guys. I'll keep you guys posted, you are really helpful! My lawyer is "threatening" USCIS right now with a letter, I don't what she is doing...and thanks desmond for the 180 days info i didnt know that they would have 180 days.

Based on your situation described in this topic- I really can't see how could a lawyer still find a reason to "threaten" USCIS, because there is really none. That lawyer is waisting your time and money. It's crystal clear that USCIS will not approve your I-485 ever. Why bumping your head against the wall over and over again?

It's kind of obvious she is just trying to get paid. I talked to her and than a month later I e-mailed her again, she literally didnt do nothing, until I talked to her AGAIN. Now she said I will wait 30 days after the letter (to wait for a reply), it's kind of obvious, every month she sends us the bill. She is just trying to get all the money she can before she says I tried everything. I hate how lawyer take granted of us Immigrants, its just so....unfair... She was like USCIS will do anything to "avoid" ferderal court when then can avoid the situation, in otherwords, USCIS will do anything to not go to federal court when they can give us our greencard. Boiler, second opinion: MOVE. Juliava really good metaphor(I beleive it's a metaphor?), I understand what you are trying to say, it is crystal clear... If we leave before my son is 18, and if my son wants to return will he have any problems? I guess not because he was a minor?

Another good metaphor is this, you have played Russian roulette with your family long enough, the next time you pull the trigger, there maybe a tragic you could have avoided. Do you really think you can wait this out until your child turns 18, if you do then continue as you are. But remember you have been given adequate advise on how to resolve your family problems. It's time to start making plans and leave the Internet blog advisor alone. Either contact another lawyer, or continue withe the one you have, because when legal trouble happens, you will need a lawyer, not us Internet blog advisors.

If you want to move to Canada you cannot just go there and expect them to welcome you with open arms. You need a visa or Canada will also deport you. My best friend is an immigration lawyer in Canada. If you like send me a private message and I will give you her contact info.

Dude I did not read all 7 pages, but from what I read your lawyer is making fool of you form day one, she is telling you story about sueing USCIS, can you ask her on what basis she will be sueing USCIS?

In your case unfortunately there is nothing that USCIS did is wrong or out of place. You entered the country with wrong intentions when you entered country on tourist visa.

You are going thru this ordeal coz you entered the country with wrong intentions from day one.

Either your lawyer is has not disclosed something completely or something is missing in your case from B1/2 --> worker permit does not make sense are there is no such thing as workers permit.

ppl come from all the places and gain citizenship in US, but they do it via legal way, so pls dont compare them to your case.

BoB thank you for the great reply, I understand where you are coming from, I might just end up moving and you gave a really good example with the auto racing, and yes the game is over but I might move this summer or next summer, my boy is about to go in 12th grade, after he graduates I will go next summer or if things get harder and hectic, I will leave this summer and I will see about talking to Laurel Scott, you always give great advise and link

You have not learned from so many years experience still you talking about leaving this summer or next.... so there is no point in giving you right advice since you dont look to follow it anyways.

You need to leave US asap, you have stayed enough illegally and longer you stay is going to impact your kids too.

It's not like I've dont anything bad, in my whole life I always thought of someones good, and I still am.

you attempted to immigrate on a tourist visa, which is against the law, and you involved your family in this crime.

you have worked illegally for years in USA, and taken advantage of social programs that US taxpayers pay for (education for your children), another crime of theft of services.

now you want people to feel sorry for you? i don't understand. if you had bothered to educate yourself on the process of immigration before hatching this twisted scheme you wouldn't be in violation of law, or would you?

after all, this is all just about getting what you want, regardless of the law, right?

you are giving indians a bad reputation.

When the DREAM Act (in some form) becomes law, your son will receive some form of amnesty, which will result in a path to lawful permanent residency and thus to a Green Card. Unless they also change the rules of the game, any Green Card holder can apply for naturalization as a US citizen 5 years after becoming a resident.

no way the dream act will become law. republicans will take the senate in 2012, and even if they don't they will retain the house.

the "dream act" is only a dream for illegals. for Americans it is a nightmare of increased taxation and social burden, as well as an affront to American legal jurisprudence.
