BoB thank you for the great reply, I understand where you are coming from, I might just end up moving and you gave a really good example with the auto racing, and yes the game is over but I might move this summer or next summer, my boy is about to go in 12th grade, after he graduates I will go next summer or if things get harder and hectic, I will leave this summer and I will see about talking to Laurel Scott, you always give great advise and link

Laurel Scott does family immigration so not applicable in this case.

You have been scammed by 2 Lawyers by the sound of it, big time.

The EB3 category for India is currently Feb 02, so I do not understand how you could have had an interview. Perhaps it moved backwards.

To repeat to be able to adjust inside the US you would have needed to maintain status. You entered as a visitor but by the sound of it have been working illegally for many years.

The next most likely course of action would be a deportation order.

No I havn't talked to another lawyer, literally there is no point left. Im thinking of moving. I have some questions if you guys like to answer...

If the Dream Act is accepted will it enable my kids to get a greencard? What is happening with the Dream Act? I know it got denied this year but I saw President Obama tweet about it, saying we will keep fighting for the Dream Act...

Lastly one more question. Lets say I move to Canada with my two sons. One of my son is about to finish his 11th grade, and if we go to Canada will they put him in 12th grade? He will finish 11th grade before we leave but we are in the United States he knows everything about the U.S. and nothing about Canada. My son is #87 our of #768 people in his class. That's pretty good with a 4.3 gpa.

If the DREAM Act passes in some form, then, yes, your boys will be eligible. Once they are residents for 5 years, they can become US citizens. Since they will be at least 21 years of age at that point, they can petition for you as their immediate relative--unless you will be found ineligible based on an outstanding deportation order or any other adverse factor.

That said, it's really anybody's guess when comprehensive immigration reform will take place. It's quite possible that it will be under Obama's second term, because at that time won't have to worry about reelection anymore. If anything happens, the DREAM Act that will benefit those that were brought to the US as children by their parents will be among the first to benefit. So there is indeed hope. It might take another 2 to 4 years, but I actually think it will happen.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . I think it's great to let godhelpme know about the DREAM act but we need to tell him what is wise. There is no guarantee and he might mess up his children future hoping for it. He needs to leave for an other country in my opinion

There is no suggestion that Obama is actually prpared to offer anything to get whatever he has in mind through.

Just posturing for votes next time around.

When the DREAM Act (in some form) becomes law, your son will receive some form of amnesty, which will result in a path to lawful permanent residency and thus to a Green Card. Unless they also change the rules of the game, any Green Card holder can apply for naturalization as a US citizen 5 years after becoming a resident.

Once your son has become a US citizen, he can petition for you and your wife, as you are his parents, and thus his immediate relatives. This way your son could get you and your wife Green Cards.

Part of CIR or part thereof is going to require enforcement, so chances of staying that long will get a lot lower.

Thanks, Bob and Boiler. But I think boiler is right, Dream Act will take on forever, I really wanted another president for a change but Obama has found Osama, now he might win the second term...Do you guys think he will win? Who else is going against him except Donald Trumpt

I'd say that Obama is your best bet for the Dream Act to stand even the slightest chance of passing.. So if that is what you are putting your hopes on, personally I would hope he stays in office. No republican will ever pass that law.
