Okay so I asked her if you have ever done a case like this and do you think it's succesfull. I think it might be my bad on this one, she said that the only reason they denied your I-485 was because they said you didnt pay them, when we did. I thought there were more reasons they denied it but this is what she said "When I say threatening, I just mean that I will ask them to go ahead and accept your I-485's and make a decision on them and that if they will not do so, I will file a writ of mandamus to compel them to do it. Many other attorney's have been successful in working with USCIS to get things done as no one wants to go to Federal Court with an issue if they can avoid it. The only reason they gave for not considering the I-485 was the payment issue. They did not decide any other issues regarding the applications. It would not have mattered if you were out of status at that time-they still should have decided the I-485's."

Is anyone going to reply? I really need to reply to the email but I need some opinions!

You're a grown man in a grown man's situation. I don't want to sound mean but you have had excellent advise and it did not cost you a dime!

You have three choices

a) Listen to the lawyer who actually knows your case and see where this ends up. Let her write the letter etc.

b) Return to your home country

c) Keep posting on VJ hoping that we know the unseen and can decipher your case.

The choice is yours.

What about moving to Canada?

Why not back to India? Life maturity and Economics have progress rapidly there recently. There is still the chance for your children to get a good education back in India. Whatever decision you make now should be for the benefit of your children, they still have a future ahead of them.

On what basis would you migrate to Canada, you can't give show up on the Canadian front without an invite.

LifeJourney: let's just say I am going to Canada...And I fly out to Canada from the United States what will happen to my cause automatically close or do I have to close it myself?

Just stop at the US embassy in Canada and let them know that you have voluntary departed (VD) the US. Your case will then close itself.

Remember this is a must that you visit the US embassy after you have left the US, if not it may cause trouble for your children in the future if they ever get the opportunity to re-visit the US.
