Wow,

I just found out that Thuys ex, out of the blue, agreed to let her son come to the US. When I filed the K1 I included the will follow option on line 31b of the DS320... I know we will have to show evidence of him growing up and his birth, but I am wondering how I restart the process for him now.... What forms do we start with for him?... I don't see a guide for K2 in this regard.. just AOS... A part of me thinks it should be a DS2001 sent to the consulate with his name and our HCM#...

I know Mike and a few others went through the same ordeal with a spouse's Ex, but I know we got lucky that it didnt take years to get him to agree... and the fact that it happened so fast makes the process different since its within a year...

Please don't move this topic to and from the P&R forum... I am looking for HCMC specific responses at this stage

I don't know anyone who has done a follow-to-join in HCMC. If it were me, I'd do the DS-2001 and DS-230 part 1, and go personally to the consulate to hand it in. Doing it during the service hours for US citizens would let you hand it directly to a CO.

Other than getting an interview scheduled, the K2 process is a lot like the K1. Same forms (except DS-156K), same fees, same medical, blah blah blah. Proof of relationship with the K1 is crucial. They really scrutinized all of the pictures, school records, ho khau, etc. for Phuong's kids.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Assuming a DS230 with his info ...

I am going to fax them a copy of those two as soon as I have the letter from the ex. in hand..

good luck scott...i don't know why the ex wouldn't. if that's also his son then he should want the best for the son, he'd obviously be better off in the US.
