So my I-130 has been approved...but I am not eligible to file for adjustment of status :(

I guess this means lawyer help :crying:

4/20/2010: Met for the first time

8/01/2010: Moved in together at his parents

5/29/2011: Asked me to marry him :)

7/01/2011: Started renting my sister's guest room together

7/14/2011: Got married officially

USCIS

10/26/2011: sent I-130 I-485 and I-765

11/02/2011: received Email USCIS Acceptance Confirmation for I-130 I-485 and I-765

11/03/2011: received NOA1 for I-130 I-485 and I-765

11/23/2011: Biometrics appointment for I-485 and I-765

01/09/2012: Recieved EAD in mail

02/08/2012: Interview Date (APPROVED!)

Your approved I-130 will be sent to storage until your PD becomes current then you will be able to apply at the consulate for your immigrate visa. What exactly is it you want an attorney to do for you?

What do you mean by "storage"? And how exactly do I know that I will be able to apply at the consulate... From an attoney I suppose to be advised of what is best to do as a next step after reciving this NOA2 since I trully dont know.

The petition gets shipped off to NVC where it will be placed until it's priority comes current, then gets assigned a visa number at which time becomes able to interview for an immigrant visa.

A couple factors if you turn 21 before priority date comes current less the time it took for USCIS approve the petition, if that happens more than likely you will get downgraded to the F2B class of priority.

A lawyer cannot make NVC issue a visa number any sooner, there are a finite number allowed per year.

My NOA2 says that the I-130 has been approved and like you said is being shipped of to NVC. However what is unclear to me is it says I am unable to apply for adjustment of status.

I do not expect any lawyer to make NVC issue me a visa number any sooner or work any rediculous miracle... I just simply think the advise could be a bit reassuring since they are experts after all.

My NOA2 says that the I-130 has been approved and like you said is being shipped of to NVC. However what is unclear to me is it says I am unable to apply for adjustment of status.

Cannot adjust status until you would be eligible to get a visa number from NVC.

You do not have a visa number immediately available, and will not have a number available for 4 - 8 years.

The only way you would get a visa number imediatly would be through marriage to a US Citizen, or a US Citizen parent filed petition for you prior to age 21, or a US Citizen Step-parent filed the petition before age 21 if marriage that made them a step parent happened prior to age 18.

NVC is currently issuing numbers to F-2A with priority dates July 06 and older (About 4 years prior to your priority date) and for F-2B July 1992.

Ok that makes total sense now. sorry for being an air head. So just because it states that I cannot file for one doesnt mean I cant file for it EVER. I just have to wait ofcourse till the PD becomes current which I totally understand will be quite a bit of time due to the retrogression. So that pretty much concludes all USCIS dealing right? at the time that i am available to apply for adj of status i will be contacted by NVC...yes? I thought this was the end of MY visa journey and was already shedding tears.

How old are you? ... As someone said earlier … you may be downgraded to F2B if you turn 21 before your PD is current, which is a very bad thing because the waiting time increases dramatically. I hope this does not happen to you!

Im 18 so I think those predictions are right :( but one can anly hope things pick up...
