Hi everyone,

We are eligible to file for ROC in a few weeks and I am starting to gather evidence. My husband and I filed joint tax returns for 2009 and 2010. We filed our 2010 taxes recently so when we called the IRS, they said the transcript was not showing up.

Does the USCIS automatically send an RFE if you only send COPIES of tax returns, instead of the actual transcript? We would also be sending in our W-2's and 1099s to back up the photocopies.

We could wait until the transcript becomes available but we'd like to file as soon as we can, assuming photocopies are allowed.

Submit photocopies of the return and all supporting documents (W2, 1099, Schedules, etc.) not just the return.

Absolutely. We will most definitely include copies of the W-2's and 1099s in addition to copies of the tax returns.

Does anyone on this forum have actual experience sending photocopies of tax returns with the relevant W-2s/1099s and actually getting approved? Most of you seem to send transcripts which is why I'm a little worried.

Hi!

We sent just copies of our 2008-2009 federal tax returns (form 1040 with all the schedules) and also copies of our W-2 for each year. We did not have any issues at all. Not RFE, not interview and approved in 4 months. I guess it's on the IO discretion to decide in a particular case whether to ask for transcripts or not. However, our ROC process was within May and September of the last year, don't know if the things have changed since.

(Day 19) 02/27/12: Passport Card received.

(Day 24) 03/03/12: Got CoN back.

N-600 for Daughter

(Day 1) 02/04/12: Application sent.

(Day 117) 05/30/12: Picked up Certificate of Citizenship at USCIS local office Chicago.

USCIS prefers the transcripts but accepts the copies. Just bring the original supporting docs to the interview for possible examination.

We submitted both copies and transcripts at various stages of the process. Never a problem.

What trips folks up is not including the supporting info. Sounds like you are on top of it.

Hello all!

I just sent my package today.

I sent copies of our tax returns but did not send any W-2's or 1099-MISC for our Schedule-C.

Well, guess I was to excited?

I will keep you all updated as it's going to be very interesting to find out the outcome!

CIS Office : Chicago IL

2009-02-27: AOS package sent

2009-03-02: AOS package received at CIS Office

2009-03-13: NOA1 received

2009-16-03; Biometrics Appointment letter received

2009-04-09: Biometrics

2009-05-01: EAD received

2009-06-16: Interview letter returned undeliverable

2009-06-22: Called URSCIS to request letter to be resent

2009-07-02: Interview letter received

2009-07-30: Interview @ 8:00am ' APPROVED - CARD ORDERED'

2009-08-12; Green card received!
