Student on F-1 OPT, not getting married or anything...further options?

Sorry Boiler but you are wrong. The INA sets out that an employer must submit a labor certification so that eligibility for the H1B to be determined.

Exceptional ability in the sciences or arts obviously does not apply in this case, therefore the employer must show (a) (i) (I) as above. Harsh, regardless of your degreed background, if you are in a flooded candidate pool, with many American applicants, the chances of getting H1B are reduced significantly.

Upto you, but I have no idea why you think Buss Grad does not qualify under exceptional ability.... :)

When infact they should have no problem in getting H1 as USICS considers them highly skilled and qualified labor.

An undergraduate degree with no experience does not constitute exceptional ability no matter what field you are in. USCIS definition of highly skilled only requires an undergraduate degree to fill that requirement. Those are two different things.

Sure a business major can and do get H1Bs. That still does not get past the current flooded market of American candidates in almost ALL job types. Not trying to rag on business here, just making sure the OP does not get his hopes up too high and is realistic.

Thats your opinion who has exceptionality skills or not.

Bach in Business would not be hard to get a H1. I am not sure where you are coming from, but as I mentioned earlier I work for one of big names and even my company is hiring as well as the ppl I know in the market are hiring Business major, Engg major all the time.

I dont know if you do the interviews or not, but when we do we do not care if they are Buss or Engg major both gets equal review.

So I am not sure where you getting your infor from.
