Timeline

Among documents that fiancée required to bring to the interview they mention divorce certificates for any previous marriages, both for the applicant and the beneficiary. But I have submitted my divorce decree along with I-129f. Will be the copy of my divorce decree enough or I will have to order another one from the court?

If you have an original sealed from the court that is the best. I was also advised to include an EOR letter for my first marriage with the documents for the interview. I think it is mainly intended for people who have a previous foreign born spouse but better to have it and not need it than to need it and not have it.

You just answered your own question. :)

Your question is a logical question, but this is not a logical process. Don't over-think it. If she's required to bring it, then she's required to bring it. There is a very good chance that they would just use the divorce certificate you supplied in your I-129f packet, but why take that chance? Re-scheduling an interview or waiting for them to receive it after the interview is inconvenient at best. Play it safe and send the divorce decree with her to the interview.

I did the same, since then, I ordered new divorce and previous marriage certificates (certified). A small cost but worth it because originals are required for the US Embassy interview.

I did the same, since then, I ordered new divorce and previous marriage certificates (certified). A small cost but worth it because originals are required for the US Embassy interview.

For me we used a copy. For Alla we had the original, a copy and a translation. translations are not required anymore. They kept the copy and the translation and returned the originals

We had no questions asked. If you do not have the documents they require, you will not be issued a visa. Bring everything.

To be 100 percent sure I have sent following email to the Consulate in Kiev:

Dear Sir or Madam,

My fiancée have scheduled her visa interview on April 27, 2011. For the interview, among other documents, she is asked to present "Proof of termination of any prior marriages of both petitioner and beneficiary". My question is if a copy of the Divorce Decree that I have sent along with my I-129F petition to the USCIS will be a sufficient proof.

Good people from the Consular Section of the US Embassy were very quick with their answer:

Thank you for your inquiry of April 13, 2011.

Your fiancée does not need to submit you divorce decree. She must present her divorce termination document if applicable

I’m pleasantly surprised how fast they replied to my question.

However, on the Embassy website where they describe steps for obtaining fiancée visa in Step five under Your fiancée will be asked to present:

...

4.Proof of termination of any prior marriages of both petitioner and beneficiary

...

At the same time, the info about Fiancée visa on the NVC website under "Required Documentation" states:

...

Divorce or death certificate(s) of any previous spouse(s) for both you and the U.S. citizen sponsor

...

which implies original document, not just a 'proof'

You see why I was a little confused. Well, the above email from the Consulate makes it clear

Honestly, if it's listed on the packet as required, you should just send it with her anyway. There is a 99% chance you won't need it. But you never know when you're going to get that one consulate officer who is either having a bad day or is just incompetent. By seeking clarification you have acted in a logical manner, but as I said before, this process is not logical. If you follow the instructions in the packet, you can't go wrong.

we brought a cpy of mine along and when they asked for her divorce and marriage certificates we gave them that also. we had no problems.

I will wanr you of one thing. I have an email from them that our K-2 to follow son would NOT need a police certificate from Russia (he is a student there) specifically stating that because he is a student and does not officially reside in Russia...blah blah blah.

A few weeks before his interview I called the consular section to go over everything and they told me YES he did need one! I mentioned the email and they said "Oh, sorry, that is not correct" :o Fortunatley we managed to get one before the interview.

It is a copy of a document you have in your posession. Send it. She can take and if it is not needed she can take it back.
