RFE for H1B application

Just received a RFE in our case for H1B and H4. For H4 they requested a copy of the marriage certificate when my name on the passport and original visa stamped in there is clearly stated. When we also applied for the F2 visa I provided them with a copy of the marriage certificate. Why do they need this again?

Here is part of the list USCIS sent for my husbands employer to provide as proof of evidence that the company has work available for his specialty occupation for the entire H1B validity period.

Example-Copy of relevant portions of valid contracts, statements of work, work orders, service agreements and letters between you and the authorized officials of the ultimate end client companies to whom the end product or services worked on by the beneficiary will be delivered.

Example-Copy of a position description or any other documentation that describe the skills required to perform the job offered, the tools needed to the perform the job, the product to be developed or the service to be provided, the method of payment, whether the work to be performed is part of your regular business, the provision of employee benefits and the tax treatment of the beneficiary by you

The suggested list continues for 11 items total. The lawyer said she has never seen this in all her years of doing H1B. They are working on getting all the necessary documents together to be back to USCIS soon.

Has anyone else applying for H1B encountered an RFE such as this? If so please share you experience. Thanks.

Why do they need this again? - Dude you are the one who needs the new VISA, they don’t need the VISA so if you don’t wanna Provide the documents they are asking for is your choice.

They are working on getting all the necessary documents together to be back to USCIS soon. – Then the lawyer you are working with has not done H1 in recent time, with the condition of economy, USCIS now wants to see all the contracts, between you and company and between company and the end client if your husband is working in consulting company.

Has anyone else applying for H1B encountered an RFE such as this? If so please share you experience. Thanks.

There has been an awful lot of fraud involving H1B visa's so they are certainly tightening up.

There have been press releases and media reports. Google is your friend.

Yep agree with there were lot of mis-use of h1b and USCIS has noticed it and made it more difficult to get H1b and rfe is common now for H1b
