ahh ok thanks for your answer. so if he becomes a citizen n upgraded my petition, how long then will i have to wait for my visa? seems like a long journey..

Seems like you need the step-by-step info. You should probably browse through the VJ Guides to see how the paperwork process works. Click on "Guides" in the bar at the top of any page.

Ok, your husband can file the I-130 petition now. When it's accepted by USCIS (usually within days of him sending it) then that will become the "priority date". The priority date determines when a visa number is going to be available.

Every month, the Department of State publishes a new Visa Bulletin that describes the cutoff date for each family preference visa category. You can see the current visa bulletins here:

Your visa category would be F2A - spouse of a permanent resident. When the cutoff date published in the visa bulletin is before your priority date then your priority date is said to be "current", and you can apply for a visa. The cutoff dates don't always advance by one month with each new visa bulletin. Sometimes they advance slower, and sometimes they advance faster. Right now, priority dates before April of 2007 are current in the F2A category in the Philippines, but the total waiting time could increase or decrease before your priority date becomes current. You just have to watch the visa bulletin each month and see how it's going.

Besides there being an annual numerical limit for each visa category, there's also a per-country limit of 7% of the total available visas in each category. The Philippines is often oversubscribed, meaning that the number of people waiting in the Philippines in a particular category is more than 7% of the total, so the cutoff date in the Philippines is often before the cutoff date for other countries, resulting in a longer wait time. This currently isn't the case for the F2A category, but that could change before your priority date becomes current. Again, you have to watch the visa bulletins to see what's going on.

Now, if your husband becomes a US citizen then he can upgrade his petition to IR1/CR1. Which one depends on how long you've been married at the time. If you've been married under two years then it would be CR1. If two years or more then it would be IR1. The IR1/CR1 visas are in the "immediate relative" group, rather than the "family preference" group. One of the things this means is that there are no annual limits. A visa number would become immediately available to you. At that point, you'd be able to finish the NVC processing and get an interview date at the US embassy.

It can take several months to complete the naturalization process and become a US citizen. Assuming your husband applies as soon as he's eligible, and upgrades his petition as soon as he becomes a citizen, then you should be in the US sometime next year.

Since cutoff dates don't necessarily advance at the same rate as the calendar, you're basically asking me to predict the future. However, presuming the the cutoff dates advance by one month for every calendar month, then an F2A priority date of June 2008 should be current in a little over a year.

ahh ok. My husband can apply for a citizenship in decemeber 2011 since requirement for citizenship is 5 years stay in the US and He will be 5 years in december..Thanks for your help. i gez i need to speak with my husband regarding on this. How long will it take if my husband will become a US citizen? will it be faster? How long? Thanks.

I am a F2A beneficiary(spouse of LPR), my husband filed Nov of 2009, and now we're just waiting for the interview sched .... goodluck to us!!
