Hi,

I'm a U.S. citizen and my fiance is a UK citizen. We'd like to marry in the U.S. but plan to live in the UK for about two years after marrying. Our thought is for him to come over on his B-2 Visa with intent to return to the UK (and the necessary proof--employment, lease, return ticket), spend two weeks in the U.S. during which we'd get married. After the wedding I'd apply for a UK marriage visa. Turn around times seem to be much shorter for UK marriage visas based on everything we've read. Once I have that I'll join him back in the UK. Our plan is to live there for a few years, spend time with his family and travel Europe, since ultimately we would like to come back to the U.S and settle down.

My question is, will the fact that he came over to the U.S. with intent to marry (but not stay) on B-2 visa effect our applicaiton when we eventually decide to do Direct Consular Filing and apply for our I-130? I have spoken to the U.S. Customs and Border Patrol and they told me that it is not an issue for him to enter to get married if he has the proper proof that he is returning to the UK. I just don't want this to eventually hinder the I-130 application.

Does anyone have any first hand knowledge of this?

Nope, that is perfectly fine, the intent was to marry not immigrate. Keep in mind need to avoid advertising the intent to marry when arriving or the POE will also assume immigrations.

This will not affect a future I-130 filing.

Many tourists get married in the US and spend their honeymoon here. May I suggest Maui, Hawaii for that?

Why not just use the VWP?

Was thinking same, perhaps not a UK citizen, and is a person who is a citizen of a country that a visa is required for to visit the USA, for example a Chinese citizen working or going to school and living in the UK.

Like Just Bob said many tourists get married in the USA, case in point "Las Vegas"

Marrying on B2 is not a problem at all, if there is a reason for you guys to be married in US then you have to go thru this or you guys can even get married in UK.

I am sure you can visit UK on fiancée visa and get married there, it does not have any impact on your DCF processing whenever you are ready to go for it.

Marrying on B2 is not a problem at all, if there is a reason for you guys to be married in US then you have to go thru this or you guys can even get married in UK.

It is allowed, however marrying and then immigrating to the USA on a B-2 is considered visa fraud if the B-2 is clearly used with the intent to immigrate as in adjusting status after getting married..

The OP is NOT asking about this. They are asking if getting married in the USA while on a B-2 and then returning to the home country would affect a future immigration petition, it will not.

The OP is NOT asking about this. They are asking if getting married in the USA while on a B-2 and then returning to the home country would affect a future immigration petition, it will not.

Dude look at my response....lol DCF Process can only be done while both USC and spouse are out of the country so there is no question of doing a AOS while they are in country on B2.

OP says they want to get married in US and then USC would go to live in Europe and later after few years file for the spouse to move to US to which I said that would not have any impact on their application.
