I am 50 years old and my husband is 24. Our petition was approved by USCIS. I front loaded the petition with pictures, emails, phone records and letters from both my husband and myself. Our petition was approved in 4 months.

The fact that your petition was approved by USCIS is no guarantee that the visa will be approved and issued by the American Embassy the day of the consular interview though. Many people are denied the day of the interview and this issue of age is very much Embassy-specific.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Go confidently in the direction of your dreams. Live the life you have imagined.

I so much appreciate all the comments. Umit does truly love me. I have no doubt. I truly love him because he is the most amazing person I have ever met. His family, now my family, is precious. I know the Embassy will see how much we love each other. I was hoping they would give us a chance to prove it. If his visa is not approved, I will give up everything and move to Turkey.

I totally understand why people think a 26 year old male can not be in love with a 55 year old female, but every case is different. Does the USCIS consider all these cases as high fraud? Has anyone on VJ been approved with this big of age difference with the female being older?

Thank you for your reply.

I think that you must have strongly evidence to present to your consulate interview. I guess that they must have lots of question about your relationship. Love has no race, age, color or social status.Love is love. But in this case, the american embassy in your country maybe want to avoid fraud. So, if you demonstrate your bona fide relationship and show strong evidence of it, it must be ok.

May God be with you.

Well my dear I sure know I am in the same situation my husband is 27 and I am 49. I have no idea what our outcome will be. But to me age is only a number and they should not see it as nothing more. Love come in all sizes, shapes, ages and so on. I wish you the best of luck and I pray we all have our loved ones with us very soon. Take care...

Reading these comments are helping me. I can not believe how stressed and hurt and angry and sad I am over this. I just do not know what will happen and I love him so much and he loves me so much that I can see this is hurting him as well. Knowing we are not alone sure helps.

Thank you,

Terry

I agree with you love come in all sizes, shapes, ages but the US Embassy doesn't really care if in the country is highly unusual for a 27 years male to marry a 49 years old woman specially when there might not be any children born to the marriage. Load yourself with evidence of relationship and hope for the best.

Hi Terry & Umit,

I just answered our thread regarding age, age requirements in different countries (see wiki link) & what the UN says about min age of marriages, etc. I hope this helps you in some way.

Re: Age...... This question comes up a lot in the MENA forum where women are often older than the men, yet it doesn't in the RUB or PI forum where men are much older than the women!

AGE DIFFERENCE IS NOT AGAINST THE US LAW by two consenting ADULTS. It is illegal if it's an adult of 18+ and a child bride/groom under 18- years of age.

The applicants (petitioner / bene) must meet all criteria as set forth by the USCIS requirements. Remember Proof is in black and white evidence; meaning it is "on it's face' without either of you standing there to defend yourselves. There should be NO QUESTION FOR A CO regarding your a bonafide relationship in the case of a K1, or a bonafide marriage in the case of an IR-1/ CR1. Be sure all evidence will show such. Please note the difference between primary evidence and secondary evidence.

Marriageable age: Here is the Wiki reference for various countries (incomplete) --- legal age to marry both Male and Female. You can further research this by hot linking your beneficiary's country.

http://en.wikipedia....arriageable_age

From the United Nations re: Human Rights on

Convention on Consent to Marriage, Minmum Age for

Marriage and Registration of Marriages

Opened for signature and ratification by General Assembly resolution 1763 A (XVII) of 7 November 1962

Entry into force: 9 December 1964, in accordance with article 6

If any of you have questions regarding age differential and legalities... This is from the UN website:

http://www2.ohchr.org/english/law/convention.htm

Desiring, in conformity with the Charter of the United Nations, to promote universal respect for, and observance of, human rights and fundamental freedoms for all, without distinction as to race, sex, language or religion,

Recalling that article 16 of the Universal Declaration of Human Rights states that:

(1) Men and women of full age, without any limitation due to race, nationality or religion, have the right to marry and to found a family. They are entitled to equal rights as to marriage, during marriage and at its dissolution.

(2) Marriage shall be entered into only with the free and full consent of the intending spouses,

Recalling further that the General Assembly of the United Nations declared, by resolution 843 (IX) of 17 December 1954, that certain customs, ancient laws and practices relating to marriage and the family were inconsistent with the principles set forth in the Charter of the United Nations and in the Universal Declaration of Human Rights,

Reaffirming that all States, including those which have or assume responsibility for the administration of Non-Self-Governing and Trust Territories until their achievement of independence, should take all appropriate measures with a view to abolishing such customs, ancient laws and practices by ensuring, inter alia , complete freedom in the choice of a spouse, eliminating completely child marriages and the betrothal of young girls before the age of puberty, establishing appropriate penalties where necessary and establishing a civil or other register in which all marriages will be recorded,

Hereby agree as hereinafter provided: (cont. on link given above)

Good luck,

Mari

Hi Terry,

My husband is younger than I am. I'm 45 and he's 30...As long as you have good solid proof of your relationship, you will be okay. Be sure to submit every little thing, like phone records, eMails, Chats, Plane Tickets, Photos, etc...

Take care
