Medicaid and the Immigration Process

Ok.... here me our before you start judging :o) We just found out that I am prego <YEA!> And I am trying to go over all my options. I am a professional Pet Stylist... aka a Groomer... I work for a Mom and Pop shop that does not offer insurance of any kind... My Husband has his buisness in India so he does not have access to insurance either... I have had 3 c-sections in the past and I am positive that we will have to have this one via a c-section also.... My question is this:

My Husband came to the US on a CR-1... Will me filing and recieving Medicaid Benefits hurt his visa in anyway? Like when we are trying to lift conditions and everything...

The only thing we need Medicaid to help with is the actually birth which normally is around 10k for a c-section... we can pay for everything else..

thoughts anyone....

also.... I am really considering having the Baby in INdia... just trying to work out all the details right now

I am not sure how the CR process works, but from my personal experiance, if you are the petitioner (US citizen) applying for benefits does not hurt the immigration process since you have been paying taxes so you have basically paid into the system. I have not seen any immigration forms inquiring about the petitioner (USC) receiving ant federal or state aid .

Here in GA we have 'Right from the start medicaid', this is a special medicaid for pregnant women which covers prenatal care, delivery and post delivery check up.

Hey, I remember you in last june when you are in AP.

1. Congratulations on the adventure, pregnancy.

2. I think, Amit is ok as long as he is not asking for benefits.

Your requesting benefits does not and should not effect his visa.

Mel, 1st of all congratulations!!!! I dont think there'll be any probs w/ the lifting of conditions, since you'll have a beautiful baby to show as proof!!!! so dont worry about that.

I think having the baby in India is a great idea, but just make sure what the immigration requirements would be. Also, can your baby still become president if born outside US - dont want to have another obama birther issue in 30-40 yrs! ;)

NVC:
04-29-2010: INTERVIEW ASSIGNED FOR JUNE 10TH IN CHENNAI CONSULATE, INDIA; 06-10-2010: INTERVIEW - VISA APPROVED!!!!!
06-18-2010: Entered US - NEW YORK CITY and 08-16-2010: GC received! (nearly 2 months after PoE) woo hoo!
AOS for permanent 10 yr green card:

04-02-2012: NOA of I-751 and 1 yr extension of temp green card

05-03-2012: Biometrics appointment

12-18-2012: 10 yr Green card approved; 12-22-2012: Green card rec'd

N-400 citizenship:

06-19-2013: N-400 mailed; 06-22-2013: N-400 rec'd at Dallas lockbox

10-3-2013: Interview date - APPROVED!

10-18-2013: NATURALIZED - We are done with USCIS!!!

You are a US citizen and are entitled to ANY and ALL benefits that any other US citizen is (as long as you meet the income requirements etc). They will have no bearing on the immigrants process at all.

The child won't affect ROC negatively or positively. It is a misconception that having a child is good proof of relationship... it doesn't mean anything except you had sex. You can show the birth cert as proof that your husband is claiming the child as his own and that helps with proof of relationship but some people seem to think having a child means you don't need to show any other proof... you still need all the other stuff (bank accounts etc).

Either way congrats and best of luck with your decision of where to give birth! I recommend you look into the CRBA (Consular Report of Birth Abroad) stuff before you make your decision because sometimes it can take a while to get the documents through. Your child will require his/her US passport before you can return to the US with him/her.
