He/she anyone can apply for the visa they qualify for. The goal for all visa is to use it for it's intended purpose.

The DOS website says applicants with a pending case can apply for student vias. Im thinking the same for my brother

Thanks Ricardo4Eva2. After I130 approved and case transferred to the NVC, do you think that it still be considered as pending?

If we can apply for a student visa, it could be great..

you are welcome. Yes - the case will be pending all the way until the INTERVIEW when a decision is made.

when applying for student visa, the application or the interviewer will ask you if you know of anyone in the United States, once they found out you are in the states, wouldn't they deny your student visa because of immigration intent?

also, can I be the sponsor of my oversea spouse for the student visa?

You are more then welcome to apply for F1, chances are CO is going to reject your F1.

Guys if it was that simple, all the spouse waiting to reunite with their respective spouse in US would apply for F1 and beat the system and get to US before their CR or K visas were approved.

Don’t you think CO would be able to connect the dots and find out why one is applying for F1, when they have their immigration application in the system?

Ohhh yees CO’s can see that one has a pending application in their system.

How?

Student Visa seems extreme bearing in mind the wait vs course length,

How?

Student Visa seems extreme bearing in mind the wait vs course length,

Well we are applying for him because he has no close relatives that lives over there. His parents, brothers and grandmother lives in the USA. He already has a tourist visa so it will be so easy for him to get a F1 visa. It is costly but would be better to help my parents maintain their residency. My eldest brother/I had tourist visas and got the F1 visas without any hassles.

I am sort of on the same boat as you.

Of course you can apply, but the tricky part is to convince them he doesn't have immigration intent...

Why can't the US just let spouses who are waiting for the PD to have a chance to visit their family in the US? Maybe have some rules such as: if he or she does not go back, forbid them to get a social security number or something...

They do.

They are not eligible for a SSN.

Assuming they have no dirty deeds, and are not Canadian or eligible to use the VWP, they apply for a Visitor Visa.
