USC petitioning non-USC sister to the states

hi, i recently had my citizenship done about november 2010. I have a sister in the Philippines whom I want to petition,

does anyone know how long that usually takes and what needs to be done for that? Thank you.

She is already married with 2 kids. She actually has a GC in the process because of her employment as an RN, that was started since aug 2006. I know there is a retrogression which is why her paperwork has been delayed for so long. I actually don't know what is going on with that one, neither does she. She said, it seems like a lost cause. So im wondering if maybe if i just petition her it will be faster or much better. I know if we carry on with a petition by me it will void the other application she had since 2006 but if i can get her to the US faster, i'll rather do that. It would only be her i'm petitioning not her entire family. Thanks!

Your sister would belong on F4 category if you petitioned for your sister which is currently processing APRIL 08 1988.

With her current Employment-Based preferences which I think she is in 3rd preference being an RN, the current processing date is AUGUST 22 2005.

If that is the case, she is better off with her current application for GC based on employment.

I am going to disagree with everyone and say if you have the funds, file for her.

Yes, it looks like it will take much longer, but things can change, plus what if the employer changes his mind and stops the process? At least you'd have another option then.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

i hope you don't mind me barging in :blush: , if in case i petition for a sibling, is there an age limit? or it doesn't matter? coz all of my siblings are over 21

No age limit, just they share a parent with you. Their children must still be under 21 when the visas are issued to come at the same time.

This will not be over quickly. You will not enjoy this.

yeah i was still thinking of that. if im not mistaken, Obama dropped the HIV testing for visa requirements right? who knows they might make it a little bit faster. yes, it may take time but at least something is already being done.. If there's still nothing on her GC based employment in about 2 years, maybe it's bound for nothing.

Obama had nothing to do with dropping the HIV requirement. That was based on a recommendation from the CDC.

Obama also has nothing to do with the wait time. There is a statutory limit on the number of family preference visas that can be issued in each category per year, and no country is allowed to receive more than 7% of the total available visas. The Philippines is heavily oversubscribed, meaning there is a very long line in front of you. That's why the wait time is so long. The wait time is reduced when some people don't apply for a visa when they become eligible. Essentially, they get tired of waiting and get out of line. The wait time is increased when people join the back of the line faster than people in the front are getting visas. There's nothing Obama can do to fix this. Congress would either have to increase the annual cap for F4 visas, or remove the 7% per country limit, or people in the Philippines would have to stop joining that long line.

The costs will be distributed over many years, but it begins with filing an I-130, which currently costs $420.
