I 134 - Supporting Documents? [edited title]

I finally got the NOA2 now I need to move on to the next steps I134, NVC & Embassy etc.

So I have many questions

I have been gathering everything since filing my I129F

When is it really needed?

I noticed that the current form I have filled out is valid till 5/31 but I am not really expecting to get to the interview till after that time

How may years of taxes have most of you put in your I134?

What else do you feel is needed besides what is listed in the Forum here?

These are the normal ones, taxes, bank statements,any statements on assets, employer verification, etc

Is an electronic employment verification acceptable?

Is a letter from the bank regarding the opening of your bank account necessary?

Any help is appreciated

I used my latest 3 year tax return transcript. I also included the W2's for those 3 years. Employment letter statement and your paycheck.

Some people in VJ members stated that if your yearly income is more than the required yearly income for the number of household size, then you just need your tax return transcript, W2, Employment letter statement and your paycheck.

However, with mine, I included my money in the bank, 401K, life insurance, car value. Again, some VJ members will tell you that yearly income is enough.

It's also usually said that by providing transcripts you don't need to provide your W-2 - just your recent paystubs and possibly a letter from your employer.

Bring whatever makes you feel comfortable. If you're barely over the requirement for your household, I'd probably list assets if available. If you're way over, probably not a big deal.

When income is clearly sufficient, simply leave all asset related questions blank. You only need to document bank accounts you list on the affidavit. A bank statement will do.

So documenting a asset such as a home is not necessary!

I'm pretty sure that I'm covered in the income dept, I'm not wealthy but I think I cover more than the 125% required

The instructions on the I-134 itself tells you what you need to submit. If you look at the sample form that VJ provides, it is just the income, and property owned (house). I plan on using my income with a letter from my employer and Savings Bank Statement. The only time they ask for a tax return is if you are self employed.

The instruction are old, like the form is. The best practice is to provide three tax returns, self employed or not. No need to provide a bank statement if your income is sufficient.

Ok, so our lawyer told us that we will need to submit and prepare the bank statements for the last 12 months...really??? because it would take awhile to gather this info, and the on-line statements would only show the recent bank balance and not the average bank balance for each month.

We are just planning to bring as support the 2010 tax return & W2, recent payslips, employment letter showing more than enough earnings...are these ok?

Generally, when income is sufficient, I advise leaving all asset questions blank. However, your attorney SHOULD understand your case more completely than I do. Why not simply ask the attorney this question?

The instructions were written by USCIS. You aren't submitting the I-134 to USCIS. You're submitting it to a US consulate. They're not even the same branch of the government. The consulate will usually tell you what evidence they require, as a minimum, with the I-134. Most consulates will want a tax return. You'll have an easier time if you ignore the form instructions and pay attention to the instructions in packet 4 from the consulate.

Check the regional forum to see if the consulate really needs those bank statements. I seriously doubt it, unless you're self-employed.

The published requirements for the discretionary decisions, like the "public charge" requirement, are often somewhat vague. Attorneys sometimes get into a habit of doing things a certain way because it's what they've always done, and it's always worked for them, but in many cases it may actually be completely unnecessary.

Depends on the sponsor's household size, including the intending immigrant(s). Most people presume the consulate will apply the same standards required by INA 213A for the I-864 affidavit of support, which is 125% of the poverty guidelines:

Official Department of State policy is that the I-134 requires a minimum of 100% of the poverty guidelines, and some consulates repeat this policy on their own websites. However, some of those same consulates have been known to deny a visa application on the "public charge" requirement when the sponsor met the 100% level but was under the 125% level. It's safer to presume they'll use the higher level, since that level will be required when it comes time to submit the green card application in the US.

we exactly do not have 100% faith on our immigration lawyer because of some delay with our initial I-129F processing and other few matters i.e. untimely replies, they only learned our Noa2 got approved cuz we told them, no advice yet re. preparation for packet 3 - but we already collated them anyway because from our research and from VJ...so, it's just good to know fellow VJer's opinion we're still waiting from NVC anyway, so we're going to do it and will still have time to gather all past 12 bank statements...just wondering if it's really necessary...and yes their reply is it's in the I-134 instructions requiring us to provide info on date account opened, total deposits to the account during the year, and the present balance...and yup i admit they're correct it is stated there and lawyers are by the book...
