Hi.

Can any qualified person give me the correct answer here please?

Totally distraught !!!

I recently received notification that I am able to apply for naturalization/citizenship.

I got married to my wife (US citizen) on 31 Dec 2006.

I received permanent resident status on 20 Feb 2007.

She left me and got a divorce in June 2010, thereby I was married for 3 1/2 years.

From the info available, I am quite confused regarding whether I am legible to apply for citizenship or not, as it states that I must have been married for the last 3 years!!!

Can anybody clarify this issue ? Can I apply for citizenship after 3.5 years of marriage, even though I am now divorced?

who says that you do quailify, who sent you the letter?

they probably don't know that you are divorced. so you don't quailify. once you divorce you have to wait until 5 years

90 days before your 5th year you can send your N400.

to file for the 3 year, you must be married and prove that you are still married to the petitioner.

How are you qualified to provide this answer?

It says it in the instructions and check list for the N-400 application on the USCIS website.

You must be an LPR for 3 years married to and living with the same US citizen that petitioned you.

If you divorce you only qualify if you are a LPR for 5 years.

Many people on the website already went through this and there are many posts about this same type of question on VJ.

VJ is a self help website. It is not ran by lawyers or immigration personnel.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

I didn't ask for the opinion "of a lawyer", I asked for somebody that knew what they were talking about or who has been in a similar situation!!!!!

Obviously you dont qualify !!!

Once again, I am very aware that this site is not run "by lawyers" !!!!! Thanks for pointing that out though!!!

There is language pertaining to this matter that is ambigeous, hence my enquiry.

I would apprecaite it if I could get constructive answers from people that are in the know....without critisism.

Just because people have dealt with immigration, does not qualify them to make an educated comment.

Sheeesh way to much attitude in this forum !!!!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

AmyKathleen2005 may not be the 'hall monitor' but I am. You asked a question in an open forum based upon experiences of our members. When someone provided you with the correct information you dismissed their response asking if they were a lawyer. Your tone of voice here is inappropriate and yes, I do have the authority to make that comment. I also have the qualification to reinforce that you have received the correct response to your question. The information was always available to you with a little research on your own - the source being http://www.uscis.gov - click on A Guide to Naturalization. All of the information you need is there.

If you are coming here for advice and information, welcome. If you are coming here just to reject the information you receive and to insult our members then you may find other sources of information more to your liking.

I have no idea what "legible" means, but I know one thing: don't feed the troll, people.
