My case was transferred to the CSC and then we received an RFE telling my wife to submit her tax papers from 2007,2008,2009 and 2010 if available.

During our filing, we used a co-sponsor who makes more than enough money because my wife is in school and has not worked since 2009. We filed in December 2010 and we used the sponsor's 2009 Tax Statement and every other supporting document as requested.

In the RFE, the sponsor was not mentioned, viz: The petitioner must submit the following:

AFFIDAVIT OF SUPPORT - FORM I-864: In conjunction with the I-864 on file the petitioner must submit copies from the Internal Revenue Service Wage and Income Transcript form W-2 Wage & Tax Statement for 2007,2008,2009 and 2010 if available. The petitioner is also to provide a letter of employment from her employer.

There are other things requested but this is most striking of them all.

Please dependable VJ fellows, help me address this issue. Thank you all.

the petitioner is always the sponsor, and regardless if she works or not, she has to file a i864 as sponsor. she can have a joint sponsor, who will file another i864.

shw must also file a letter explaining why she hasn't paid taxes. and send whatever she has.

Did your wife submit a separate I-864? The petitioner is always the primary sponsor and must provide an I-864 even if the person has no income.

Yes, my wife did submit a seperate I-864 but without explanations. But she did filed for 2000 to 2008.

Yeah. Your wife needed to file an explanation as to why she was not required to file tax returns for the last few years. Keep the explanation short - wife's income was below the threshold required to file a federal tax return.
