When is the 3 years ban starts? At the time of denial of i-539 or the time of departure?

Who has to file the g-639 to get a copy of denial? My mom (she is the applicant for the i-539 and i-130) or me (petitioner of i-130)?

If the ban starts at the time of denial she is already more than 2 years out, she has almost 1 year left to lift the ban. If this is true and the ban is lifted in the next 11 months than she is within the 1 year when she can come back to Embassy for the interview and get her visa i-130. Right? Or the ban is lifted only for visitor visa?

I asked a lawyer on line and the ban starts on time of departure. After the ban she can reapply for I-130. So she can apply again next year in September.

The ban starts the day she left the USA.

I would think she has to file a FOI request as it is her denial, but not sure.
