Dear all,

My husband David and me got married in the States (Hampton/VA) in April 2006. The church ceremony is only 2.5 weeks ago. This one we had in Germany. Now my passport and ID are finally issued and we are ready to apply for a K3-Visa for me.

My question now is if they can send me home when I want to go visit him on Christmas 2006? I remember reading somewhere that they can deny me entering the States when they see that I am applying for a K3 respectively that entering is not allowed anyway. Of course I will go back home to Germany and do not intend to stay there.

Can anybody help me?

Normally with K3 the beneficiary spouse remains over seas while the visa petition is being processed then enters USA after it has been approved, and the interview is done, no way to wait for approval in the USA would have to wait in Germany.

The separation while waiting is hard, sometimes a couple American and in your case German, lives in Germany while waiting, this usually happens when the American works in the foreign country.

Many have entered the US to visit their fiance or spouse whilst they have a petition in process. Whether one is granted entry is totally up to the officer at POE. Having plenty of evidence of ties to your home country and that you will be returning is a good idea. Anyone regardless of petition in process or not, always has the chance of being denied entry. They may ask question, they may not. Just answer honestly and not offer up any more than what is specifically asked for. eg. Do you have the time......answer 'yes'......not 'yes, its half past nine'.
