I was wondering if someone can help me out with out situation. My husband has his interview on May 17, 2011 at the Consualte in Santo Domingo, DO. He was previously deported from the U.S. So I just want to make sure that I have this correct. At the interview the visa is going to be denied and then do we give them the I-212 and I-601 at the interview? I also have to have an extreme hardship letter correct? And does anyone know the process after that? Do you know how long the process will be after we turn in both the I-212 and I-601? Is there a posiblity they will give us an answer at the interview for the other 2 forms? Please help!! Thanks.

Hello Chelilabombera,

I do not have an answer to your specific questions about the waiver so I will let more experienced members comment on that, but what I did want to make sure to tell you though is to make sure that YOU (the USC petitioner) are also present at the interview. It is imperative that ALL petitioners with Dominican beneficiaries be present at the interview since Santo Domingo is considered a high fraud Embassy and approvals are not granted if the petitioner is not present at the interview.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

There is another forum immigrate2us.net that specializes in waviers. They have samples of what you need to do. It isn't easy to write a correct wavier and you may want to consider professional help.

They will not give him the I601 or the I212 they will give him a sheet of paper at the interview with his inadmissability written down. Or it might take a week or a month or more for this formal document. If you know he needs a waiver and an I212 get busy researching what this means and how to prepare one. It includes a statement of your hardship, "hardship letter" and the evidence to prove your hardship. Its almost impossible to get approved without the evidence.

Since this is a legal proceeding with tremendous impact on your family if you do not feel comfortable or understand it get an attorney who does these frequently and in your family's country of application even better.

There is a research link on this forum and some guides, read everything you can and as previously posted visit i2us.net and ask lots of questions and read sample Hardship Letters and forums on your region.
