I am a little embarrassed to admit that I can figure out how to read the USCIS's Visa Bulletin. I am a permanent resident in the US and I am trying to sponsor my under 21 year old daughter. The USCIS rejected the entire application package because they say that priority date is not current. Sorry to ask what must be a simple matter for old-hands here. Bark.

In case it helps, we are Canadians. Again, thanks for any help. Bark

People here can help you, but you need to tell us this:

- Age of your daughter

- Have you already file I-130? IF yes what is you Priority Date (a.k. when did you file)?

- Since when are you a LPR?

May-2011 Visa Bulletin just came out.

Cut Off PD for F2A is 08-jun-07 (It had 2 months forward movement... Great!)

Thanks for the replies.

My daughter is 17, I filed I-130 and I-485 together on the assumption that visas for Canadians unmarried offspring under 21 are current.

Thanks for the replies.

My daughter is 17, I filed I-130 and I-485 together on the assumption that visas for Canadians unmarried offspring under 21 are current.

it doesn't matter from what country she is from. children of LPR of any age cannot adjust in country unless they are legally in the country with a visa, such as a student visa and the priority date becomes current while the visa is current.

the waiting for the priority date is more than 3 years.

only unmarried children under 21 of a USC who entered legally may be forgiven the overstay and adjust in country.

children of LPR will go through consular processing in their country of origin, in your case, she will have the interview

in Canada.

you are only elegible to file the i130. the approved i130 will go to the National Visa Center, which cases will go through consular processing. There it will sit until her priority date becomes current, in around 4 years.

She doesn't qualify for the i485.
