Hello everyone,

I am looking for an answer at my situation. I am on EI for the last couple of months, I got the K1 visa last week and I’ll move in States next week. If I am on EI insurance should I call them and tell them I move in States on K1 visa? Will they continue to pay me while I am in States too or they will just stop the payments from that day on?

I am afraid they will want me to pay back the money I received from them lately because they will think my intention was to get the visa and move in States and not to look for a job here. The truth is I was looking but I didn’t find anything at an equal level I had before. I really don’t know what to do here and I have no idea if I can continue to get EI after I move in States being on EI here in Canada for a couple of months already.

Likely they will stop payments. You have to be ready, willing and able to work to collect EI. When you arrive on a K-1 you are not able to work.

I worked right up until i left, had my employer put that i was quitting for the purpose to relocate to marry...which is allowed. The thing is on the cards you cannot shade in that you are able...to work until you get your ead card...which takes about 3 months...mine is in the mail and i filed for it early February...and when i get it i have to fax ottawa with my card number and then they will start paying me my ei...minus 25% for the international. frustrating....i have sent back at least 10 cards...what a waste!

so...if you only have a few weeks left on your ei...may as well just cancel it as its not retoractive...either way...you have to let them know.

You can always tell them that you had no idea when you would get your visa...could have taken several more months...so of course you were looking for work!

So is your situation that you're currently on EI even before the move to the US? If that is the case, they 'MAY' place your claim on hold as of the date you move, until you Adjust status and get your EAD (employment authorization) and then they can restart the claim when you can provide the EAD as proof that you're now able and willing to work in the US.

I don't think they'll ask you to pay anything back you've already received. What you've been paid, they determined you were entitled to it and eligible. There's nothing illegal about moving to the US and them still paying you EI if you're entitled.

Definitely communicate with them and find out what you need to do and what they will do.

For me, they put mine on hold until I got my EAD, but they did not extend my benefit, so I didn't get anything between Jan and the end of March, but my EI ran out in June, so I only got up to then. Your case will have to be transferred to the international department, so you will have to fill out the cards instead of continuing to use the site to fill out your reports.

Thanks, this was helpful! :) I still have EI until the end of August and I will still get maybe 2 months of EI in States. I will get married at the end of May and fill for GC and EOD at the beginning of June.

I can't recall, but I think the benefit period may be a bit shorter as well for "International" Probably wrong though,lol

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1
