hello everyone

i am new user here , but have been read alot here and it was helpfull to me with my case . i got deny 23 march from uscis after 11 months waiting and after sending FRE back to them they deny us by strange way , even when my wife went to the lawyer , he told he they shoudln't deny . it's just bullshit reasons. i told my wife to come to fill from my country but the lawyer told her to better to fill again from there and sure with him when i belive the lawyer don't do much as we do all about the papers right ? my Q to let my wife fill again from there or better when be with me here ? and lawyer said no hope from appeal coz it can take years , and if we filled again without lawyer from there did u think guys my deny will effect on the new fill coz sure we will write it in i 130 or it will not effect ? and there is ppl tell we have to wait 6 months to can fill again is that true? and what a chance we have if we filled again ? pls need help

I think that we all need to know some more information concerning your case. We need to know where you are? Where she is? Who's the beneficiary and who's the petitioner? Most importantly the reason for the visa denial? :thumbs:

Summer 2007: Hubby and I met.

January 2008: Engaged.

May 22,2008: Hubby and I got married!

August 2008: I-130 filed.

January 2010: Our son was born.

May 2010: Interview at US Embassy in Barbados. Visa Denied! Eligible for I-601 waiver. Couldn't get a joint sponsor so we had to wait until 2011 when my income tax return documents would reflect my full income.

Feb22,2011: Embassy Received Tax Docs and New AOS!

Feb28,2011: I-601Waiver App Package sent to USCIS Santo Domingo via airmail.

Mar28,2011: USCIS Santo Domingo received Waiver Package.

Jun13,2011: Waiver Approved!

June24,2011:Embassy requested that medical police cert and other docs be updated and sent to schedule final interview for visa! *crosses fingers*

FINAL INTERVIEW SET FOR SEPT. 1ST @ 7:30AM

im sorry, but as i read in VJ it seems like those who hires a lawyer for their immigration process always seems to have problems. .

anyway, u need to tell us more info. I also got a denial decision 2years ago, reason was i didnt respond to the RFE (my fault). as i was told an appeal takes longer and I think costs more. So, we refiled last year and was approved. If I we're you just follow instructions at the USCIS and be thorough to avoid RFE, goodluck!

i am egyptian and live in sudia arabia , and we filled in april and they send us RFE after 7 months need more prove , we send alot of stuff , my wife have been 3 times all of them in egypt when i got vacation from sudia arabia , reasons is shitty really , why we didn't have wedding whitch it's not big deal to make it when we have someone in family dead , plus they ask why my family wasn't with us when we get married like we are child and talk about my family not live far from cairo so they could go to our marriage in the minstry when we have alot of pics with family , they talking about my wife first time came spend only 1 week saying pyramids and musum and that was short , how and she came again and stayed 1 month when we get married , coz she can't lose her job , it's really stupied reasons , we have age diffrent but they never talked about it coz as we know it's unlegal , so what do u think guys ?

we filled without lawyer , but after we got deny , my wife went to ask lawyer about what next , he didn't advice with appeal coz take long time and cost more , and he advice to fill again from usa not from my country plus sure by him filling for us , did u think lawyer would help ? or should we fill again by our self again ?

maybe it varies from case to case when it comes to hiring a lawyer. personally, i think it's not necessary if it's only a simple immigration process, this website for one is very helpful than a lawyer who will charge you hundreds of dollars and u get here for free. anyways, the consul will not deny you for a "shitty reason", he will base your answer to what you guys sent. If you re-file again, just make sure you are fully informed and before you send out documents just make sure it is complete.

i do belive that there is no since for the reasons they sent to us , even the lawyer belive in that too , if u saw what we sent to them , u would say what a strongest packge coz it was full of approv , i do belive that we can re-file again without lawyer and we didn't miss anything before to take care of it now , that is the problem , and make me wonder the diffrence will be only my wife came one more time to my country , more pics more approv , that's it .

Your lawyer is correct, its better to re-file than appealing because you will have to pay a fee for the appeal and these cases takes forever. USCIS tend to just dump them somewhere hoping you'll just re-file and let the case die. Also to do DCF Direct Consular Filling, your wife would have to move to your country and establish her residency there for at least 6 months to begin with the process. For example to do this in the Dominican Republic the Petitioner must live in the beneficiary home country for at least 6 months with the Resident card from the Dominican Republic to be eligible.

Just file a new Petition and load it with evidence of ongoing relationship.

I really can't advice you rather to hire a lawyer or not, because it depends on the complexity of your case. But most people here do this without a lawyer including us. You can discuss that with your wife rather she wants to re-file with a lawyer involved or without one, and also moving there to do DCF might bring financial stress to you both. She would have to quit her job to move to your country.

it's about what we can do , coz we both confused , she think it's the right thing to re-file again from there with lawyer . but in the same time she don't want to wait apart anymore , it's hell waiting and full of stress and more computer talking and phone calls etc , we get tired of that both , but in the same time she want to work in egypt when u know setations now in egypt not help to find her a job to help each-other , just re-file from egypt not so eazy too about what we can do with money part too sure , but i got ur point
