No one is questioning whether or not this would be illegal. And people here are ones who have legally navigated the immigration system - meaning we're far less tolerant of 'cheaters' than most. So you can come off that soap box already.

We're questioning the means in which you're choosing to address it with someone who is supposedly your friend.

If I were in your shoes, I would at least go to my friend and give her the opportunity to explain herself before I went running to the government, crying foul and possibly getting her deported.

Morality would be you stumbling upon an evidence and then turn the evidence in. This case is you taking the law into your own hands trying to set up someone you call a friend. You should let this one go as you know you have no evidence to prove anything. Trying to set up an evidence might get even you in trouble.

2. what excatly did she commit to obtain the visa?

3. Sometimes you said "They", sometimes you said "She", did that mean both the woman and the USC conspired on the fraud? Or the woman did it alone by deceiving the USC or what?

My guess is that unless you had substantial courtroom quality evidence, they won't do anything. We had very malicious predators call state agencies and make false claims against us, including human trafficking. They probably contacted immigration too, after seeing what yarns they told the state authorities. But nothing happened to us with immigration.

The federal adjudicator was very sweet to us in our interview and we had no problems. My wife was way pregnant in the interview and we had hundreds of pages of primary evidence. The state people were morons and actually invaded our home, separated us, interrogated us, and they asked her whether I was withholding her papers or if she was there voluntarily - as if there weren't already a federal immigration office overseeing that.

I would say that the federal immigration people get many "sour grapes"/spite/envy calls about men buying wives or pulling fraud & etc. They can't go on accusations.

Make no mistake, none of us here is happy with those that fraudulently get their visas. We would like for them to be caught. We are only trying to let you know you have no evidence to make the case, and trying to set up one is going too far. Like Darnell already said, some states have laws against recording voice, video, or other electronics stuff without the consent of the party involved. Good luck.

This is not actually any fraud topic - it, instead, is a benefit of being married more than 2 years ONCE the intending immigrant arrives at a POE.

A visa is not conditional - at all.

Having a visa will result in a green card being issued -

if the marriage is less than 2 years prior to POE entry - then a Conditional Green card, 2 years duration, is issued.

If the marriage is more than 2 years prior to POE entry, then the Unconditional Green Card is issued, 10 years duration.

Is not, by itself, any indication of FRAUD - instead - is a benefit of 'marriage duration'.

SO - by itself, no - not fraud, IMO.

I would be hunting for 'other things' besides this one - card issuance and type is a benefit - Many couples decide to delay submittal, processing, and POE date SOLELY because of the '10 year card' - it's much less hassle with USCIS after the POE step.

Delaying entry is NOT an illegal activity, at all - I think you're confused, much.
