Dear Visa Journey,

I am new here, not sure if that's relevant or not. i come here today seeking advise as to what i should

do about a person whom i have reasons to believe obtained their immigrant visa by fraud, i have their names

and phone numbers, addresses and a lot of information about them, because the woman involved is my friend

i do not have physical proof that they committed visa fraud but i know because i heard them talking about

it. the problem is the woman already received her visa,it is conditional but she has been married for over 2yrs

and so i heard her on the phone telling some one that she can change it to the 10yr green card once she is at her

port of entry, (is this true??) and if yes can i still report her and have her arrested and turn back at the port

of entry??

i know y'all might be thinking why i am doing this to my friend, but i do not condone illegal activities

full stop! nothing else to it.

Wouldn't things for you be jeopardized and you be at risk for committing a crime by recording a person without their permission? Looks to me like you will be over your head and you won't hurt her only yourself. You can go to jail for what you have planned. You had better think long and hard on that fact. Isn't worrying about your own life enough.

If she was such a good friend to you, why would you not tell her husband?

Better yet, why didn't she tell you?

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Did you mean that to be a question, or are you actually stating that everyone is hateful?

well she started out asking what she should do after encountering immigration fraud,and half the answers she gets is to mind her own biusness,and not to worry about it,maybe hateful is not the word,but still scratching my head though.

This is not actually any fraud topic - it, instead, is a benefit of being married more than 2 years ONCE the intending immigrant arrives at a POE.

A visa is not conditional - at all.

Having a visa will result in a green card being issued -

if the marriage is less than 2 years prior to POE entry - then a Conditional Green card, 2 years duration, is issued.

If the marriage is more than 2 years prior to POE entry, then the Unconditional Green Card is issued, 10 years duration.

Is not, by itself, any indication of FRAUD - instead - is a benefit of 'marriage duration'.

SO - by itself, no - not fraud, IMO.

I would be hunting for 'other things' besides this one - card issuance and type is a benefit - Many couples decide to delay submittal, processing, and POE date SOLELY because of the '10 year card' - it's much less hassle with USCIS after the POE step.

Delaying entry is NOT an illegal activity, at all - I think you're confused, much.

What I don't understand is the original poster has obviously made up their mind that this is the case and they are going to take some action, so why are they posting here. People are answering their questions, but it seems they don't like the answer so they try to convince us here that the woman did commit some kind of fraud and they are going to report them. Well good on you, go ahead and report them and let the chips fall where they may. Trying to convince people here on VJ of the situation doesn't accomplish anything.

Why not just let sleeping dogs lie, and go about your own business. You are neither a detective nor an immigration officer of any sort yet you are putting so much time and effort to burn someone you call a friend. My advice, do not tape anyone without their consent and you know if they consent, they'll not say what you want to hear. Fix your own house before worrying about others'.

I see the whole thing as a mere Jealousy.I am pretty sure u arent a cop or an FBI while the hate???? It is good you let go and let the apporopriate authorities deal with them if found wanting of anything, The truth is always constant.Life is too short than to be going about monitoring other people's business, I am sure you have a lot more important things to invest your time on.All the best.
