"Places you've lived within the last 5 years..."

I'm actually an ROC (I-751) filer, but posting this here as AOS forum gets more traffic and I feel this is an issue relevant to both.

If one goes for biometrics and they are rejected twice in a row, you can expect to get an RFE asking for police certificates from everywhere you've lived within the last 5 years. Or... do you?

I've heard such conflicting information as to what that ACTUALLY means. Some say they want police records from just within the US, from every city you've lived in. Some people say that includes places outside the US, if you've lived in said places within the last 5 years. I've read a post from someone who said they called the USCIS helpline and were told the letter that gets sent out is a "stock" letter used more often for naturalization applicants, and that if you've been here less than 5 years, you only need to get records from within the US, not outside. Certainly seems odd that they would want you to essentially resubmit old records that you should have submitted during the K-1 period, especially if you've never gone back to live in your country of origin since then!

So my question: if you are asked to submit police certificates/Certificates of Good Conduct and you have been in the US less than 5 years, do you have to include certificates from other countries you've lived in, or not?

And please... how can I put this without sounding like an a$$? :whistle:Please respond only if this issue actually occurred for you and what you did was approved by USCIS, or if you yourself called the Extortion Line and were given a definitive answer by an agent. "I would imagine"s and "I expects"s are not really a lot of help. /endbeinganass :innocent:

This hasn't actually happened to me, but I had my second set of prints taken today after the first were rejected, and I'd like to know ahead of time what to expect if they're given the thumbs down again.

Timeline

Police certs are a visa thing and are only part of NVC/Consulate processing for immigrant visas.

Police records are not required from the USA, they are handled when USCIS and other departments run prints through the FBI.

I thought the whole point of these RFEs was that the FBI COULDN'T handle it, due to not being able to run checks on reliable prints.

I thought the whole point of these RFEs was that the FBI COULDN'T handle it, due to not being able to run checks on reliable prints.

They wont RFE for this when removing conditions, in the 4 years I have frequented this forum, I have yet to see a post about USCIS request police reports from other countries when adjusting status or when removing conditions.

"CERTIFICATION OF GOOD CONDUCT: The applicant's fingerprints have twice been rejected as "illegible". Please provide a letter issued by the local law enforcement agency (County Sheriff or Local Police Department) indicating the applicant has "no criminal record". The record search should include all the aliases the applicant has previously used. A separate letter is required for each law enforcement district in which the applicant has resided during the previous five years."

Now, admittedly, the most recent thread I could find where someone had written out exactly what their letter said was from 2009, so the wording may have changed since then. But do you see what I'm talking about? No, it doesn't specifically ask about other countries, but that's the problem; it's not specific.

All residences within the USA. I also looked into this when my first prints were rejected. I didn't get a RFE, my second ones were OK, but since no one else with firsthand experience has posted yet .....

Field Operations I-485 Standard Operating Procedures, version 2.1, indicates that applicants with twice rejected fingerprints are ineligible for an interview waiver and therefore must appear in person to provide police clearances and a sworn statement. That SOP further indicates that “If the fingerprint response shows two current Rejects, prepare Record of Sworn Statement (Form I-263), and request police clearances for all residences within the U.S.” When the field office calls the applicant in for an interview, the field office notifies the applicant that he or she must bring the required police clearances to the interview.
